【摘要】：近年來(lái)，，專(zhuān)利池作為一種跨國(guó)公司新型的知識(shí)產(chǎn)權(quán)壁壘，已經(jīng)逐漸對(duì)中國(guó)的手機(jī)產(chǎn)業(yè)施加強(qiáng)大壓力。手機(jī)產(chǎn)業(yè)有其自身特性，往往必須具有強(qiáng)大的科技儲(chǔ)備和超強(qiáng)的創(chuàng)新能力，但是我國(guó)國(guó)內(nèi)手機(jī)企業(yè)往往缺乏科技和創(chuàng)新能力，在與外國(guó)強(qiáng)大的科技創(chuàng)新型企業(yè)競(jìng)爭(zhēng)時(shí)，往往力不從心。研究表明，在手機(jī)產(chǎn)業(yè)構(gòu)建專(zhuān)利池并且通過(guò)專(zhuān)利交叉許可，對(duì)整合各種國(guó)內(nèi)手機(jī)企業(yè)的不用科技以及互相互補(bǔ)技術(shù)有著積極的作用，有利于國(guó)內(nèi)手機(jī)前端企業(yè)突破跨國(guó)公司的知識(shí)產(chǎn)權(quán)壁壘，開(kāi)創(chuàng)出新的格局。因此，如何理解手機(jī)產(chǎn)業(yè)內(nèi)專(zhuān)利池的內(nèi)涵以及對(duì)我國(guó)手機(jī)產(chǎn)業(yè)的穩(wěn)步健康發(fā)展非常重要。 本文全文共分為五個(gè)部分:第一部分是緒論，主要敘述本文的選題的背景和意義，國(guó)內(nèi)外有關(guān)手機(jī)產(chǎn)業(yè)專(zhuān)利池的研究綜述及本文的研究思路，創(chuàng)新點(diǎn)；第二章對(duì)專(zhuān)利池的相關(guān)基礎(chǔ)理論進(jìn)行綜述，闡明專(zhuān)利池的一般分析，包括專(zhuān)利池歷史描述、法律定義及專(zhuān)利池特點(diǎn)；第三章對(duì)探討了手機(jī)產(chǎn)業(yè)專(zhuān)利池設(shè)立的意義；第四章研究手機(jī)產(chǎn)業(yè)專(zhuān)利池設(shè)立的基本問(wèn)題，包括我國(guó)手機(jī)產(chǎn)業(yè)專(zhuān)利池的設(shè)立的組建具體途徑及手機(jī)產(chǎn)業(yè)專(zhuān)利池的類(lèi)型進(jìn)行了研究，討論了手機(jī)產(chǎn)業(yè)專(zhuān)利池的法律關(guān)系；第五章則對(duì)手機(jī)產(chǎn)業(yè)專(zhuān)利池的法律風(fēng)險(xiǎn)及其防范進(jìn)行了研究，著重以專(zhuān)利池濫用的角度進(jìn)行研究。本文研究認(rèn)為我國(guó)政府應(yīng)當(dāng)重視專(zhuān)利池的積極作用、應(yīng)有意識(shí)面對(duì)產(chǎn)業(yè)專(zhuān)利池的必然出現(xiàn)。本文不同于國(guó)內(nèi)現(xiàn)有對(duì)專(zhuān)利池的相關(guān)研究，片面強(qiáng)調(diào)專(zhuān)利池的專(zhuān)利池濫用效應(yīng)，而本文旨在更加全面地分析專(zhuān)利池對(duì)我國(guó)手機(jī)產(chǎn)業(yè)的積極或者消極的影響，特別強(qiáng)調(diào)自主創(chuàng)新和市場(chǎng)競(jìng)爭(zhēng)這兩個(gè)方面的影響。所以我國(guó)國(guó)內(nèi)的手機(jī)企業(yè)更應(yīng)該看到看專(zhuān)利池對(duì)于我國(guó)手機(jī)企業(yè)的積極影響，同時(shí)政府作為市場(chǎng)的監(jiān)管者也應(yīng)該積極創(chuàng)造有利于高新科技產(chǎn)業(yè)專(zhuān)利池在我國(guó)的生存環(huán)境。
[Abstract]:In recent years, patent pool, as a new type of intellectual property barrier of multinational companies, has exerted strong pressure on China's mobile phone industry. The mobile phone industry has its own characteristics, it must always have strong scientific and technological reserve and super innovation ability. However, the domestic mobile phone enterprises in our country often lack the science and technology and innovation ability, so when they compete with the powerful foreign enterprises in science and technology innovation, It is often out of reach. The research shows that building patent pool in the mobile phone industry and adopting patent cross-licensing play a positive role in integrating various domestic mobile phone enterprises' technologies without science and technology and complementing each other. It is advantageous for domestic mobile phone front-end enterprises to break through the intellectual property barriers of multinational companies and create a new pattern. Therefore, how to understand the connotation of patent pool and the steady and healthy development of mobile phone industry is very important. This paper is divided into five parts: the first part is the introduction, mainly describes the background and significance of this topic, the domestic and foreign research on the mobile phone industry patent pool, research ideas, innovation points; The second chapter summarizes the relevant basic theories of patent pool, clarifies the general analysis of patent pool, including the historical description of patent pool, legal definition and characteristics of patent pool, the third chapter discusses the significance of the establishment of patent pool in mobile phone industry. The fourth chapter studies the basic problems of the establishment of mobile phone industry patent pool, including the establishment of mobile phone industry patent pool specific ways and mobile phone industry patent pool types were studied, and discussed the legal relationship of mobile phone industry patent pool; The fifth chapter studies the legal risk and prevention of patent pool in mobile phone industry, especially from the perspective of patent pool abuse. This paper argues that our government should attach importance to the positive role of patent pool and must face the inevitable emergence of industrial patent pool. This paper is different from the existing research on patent pool in China, which emphasizes the abuse effect of patent pool, but the purpose of this paper is to analyze the positive or negative effects of patent pool on the mobile phone industry in China. Special emphasis on independent innovation and market competition in these two aspects of the impact. Therefore, domestic mobile phone enterprises should see the positive impact of patent pool on Chinese mobile phone enterprises. Meanwhile, the government, as the market regulator, should also actively create an environment conducive to the survival of high-tech industry patent pool in China.
