【摘要】：知識產(chǎn)權(quán)糾紛中重復(fù)訴訟的大量出現(xiàn),不僅增加了知識產(chǎn)權(quán)權(quán)利人的訴累,也會影響知識產(chǎn)權(quán)裁決的一致性和權(quán)威性,更有礙于我國創(chuàng)新型國家的建設(shè)。從理論及涉及知識產(chǎn)權(quán)重復(fù)糾紛的司法實踐可見,知識產(chǎn)權(quán)重復(fù)訴訟糾紛的發(fā)生,主要原因在于請求權(quán)的競合、知識產(chǎn)權(quán)權(quán)利界限模糊以及法律對知識產(chǎn)權(quán)權(quán)利客體的不同保護等。大陸法系國家,甚至是英美法系國家都對重復(fù)訴訟的問題作了禁止性的規(guī)定,我國民事訴訟法律也作出了相關(guān)規(guī)定。然而,適用于知識產(chǎn)權(quán)重復(fù)訴訟的民事訴訟法律無法解決其特殊性的問題。唯有進一步規(guī)范知識產(chǎn)權(quán)實體法律條款,完善知識產(chǎn)權(quán)訴訟程序,改進知識產(chǎn)權(quán)糾紛案件管理制度,才能解決知識產(chǎn)權(quán)的重復(fù)訴訟問題。
[Abstract]:The emergence of repeated litigation in intellectual property disputes not only increases the litigation burden of intellectual property rights holders, but also affects the consistency and authority of intellectual property adjudication, and also hinders the construction of an innovative country in our country. It can be seen from the theory and judicial practice that the dispute of repeated litigation of intellectual property is mainly caused by the concurrence of the right of claim. The boundary of intellectual property right is blurred and the object of intellectual property right is protected by law. The civil law countries, even the common law countries, have made the prohibition on the repeated litigation, and the civil procedure law of our country has also made the relevant provisions. However, the civil litigation law applicable to the repeated action of intellectual property can not solve its particularity. Only by further standardizing the legal provisions of intellectual property entity, perfecting the procedure of intellectual property litigation and improving the management system of intellectual property disputes, can the problem of repeated litigation of intellectual property be solved.
