【摘要】:2009年《文化產(chǎn)業(yè)振興規(guī)劃》由國(guó)務(wù)院常務(wù)會(huì)議審議通過(guò),這一重要的產(chǎn)業(yè)振興規(guī)劃標(biāo)志著文化產(chǎn)業(yè)上升為了國(guó)家的戰(zhàn)略性產(chǎn)業(yè)。網(wǎng)絡(luò)文化產(chǎn)業(yè)作為一種新的產(chǎn)業(yè)形態(tài),拓寬了文化產(chǎn)業(yè)的道路,促進(jìn)了“網(wǎng)絡(luò)文化”同“經(jīng)濟(jì)”的融合,成為文化經(jīng)濟(jì)發(fā)展新的增長(zhǎng)點(diǎn),逐步發(fā)展成為知識(shí)經(jīng)濟(jì)時(shí)代的支柱型產(chǎn)業(yè)。網(wǎng)絡(luò)文化產(chǎn)業(yè)的發(fā)展不僅給社會(huì)帶來(lái)了巨大的經(jīng)濟(jì)財(cái)富,而且方便了人們的生活,滿足了人們對(duì)文化生活的需要,給人們帶了巨大的精神財(cái)富。但是網(wǎng)絡(luò)文化產(chǎn)品中有害信息泛濫,隱私權(quán)、知識(shí)產(chǎn)權(quán)頻遭侵犯,網(wǎng)絡(luò)文化企業(yè)違規(guī)經(jīng)營(yíng)、市場(chǎng)管理混亂等問(wèn)題層出不窮,影響了人們正常的生活和工作,嚴(yán)重阻礙了網(wǎng)絡(luò)文化產(chǎn)業(yè)的健康發(fā)展。網(wǎng)絡(luò)文化產(chǎn)業(yè)的發(fā)展不僅需要健全的市場(chǎng)經(jīng)濟(jì)體制,也需要政府的有效監(jiān)管。 從我國(guó)網(wǎng)絡(luò)文化產(chǎn)業(yè)的特殊性來(lái)看,建立松緊相宜的監(jiān)管制度是規(guī)范我國(guó)網(wǎng)絡(luò)文化產(chǎn)業(yè)最為適宜的途徑。本文從界定有關(guān)網(wǎng)絡(luò)文化產(chǎn)業(yè)政府監(jiān)管的概念入手,以規(guī)制經(jīng)濟(jì)學(xué)中的公共利益理論和部門(mén)利益理論為理論基礎(chǔ),分析了我國(guó)網(wǎng)絡(luò)文化產(chǎn)業(yè)發(fā)展中政府監(jiān)管的現(xiàn)狀。我國(guó)網(wǎng)絡(luò)文化產(chǎn)業(yè)近幾年來(lái)發(fā)展迅速,產(chǎn)業(yè)規(guī)模不斷壯大,,但是在發(fā)展中也存在著一些問(wèn)題,因此我國(guó)政府采取了一系列的措施對(duì)其進(jìn)行監(jiān)管,制定相關(guān)的法規(guī)政策,建立相應(yīng)的監(jiān)管機(jī)構(gòu),實(shí)施多種監(jiān)管形式等。通過(guò)分析這些監(jiān)管措施,指出當(dāng)前我國(guó)網(wǎng)絡(luò)文化產(chǎn)業(yè)政府監(jiān)管中存在著法律法規(guī)不完善、政府監(jiān)管機(jī)制滯后、缺乏有效的市場(chǎng)監(jiān)管機(jī)制等問(wèn)題,這些問(wèn)題從根本上制約著我國(guó)網(wǎng)絡(luò)文化產(chǎn)業(yè)的健康發(fā)展。最后試從加強(qiáng)網(wǎng)絡(luò)文化產(chǎn)業(yè)法規(guī)政策建設(shè)、規(guī)范監(jiān)管機(jī)構(gòu)、完善監(jiān)管機(jī)制三個(gè)方面提出完善我國(guó)網(wǎng)絡(luò)文化產(chǎn)業(yè)發(fā)展中政府監(jiān)管的對(duì)策建議,力爭(zhēng)能夠建立一個(gè)高效透明的網(wǎng)絡(luò)文化產(chǎn)業(yè)政府監(jiān)管體系。
[Abstract]:In 2009, the Plan for the Revitalization of Cultural Industry was examined and approved by the Executive meeting of the State Council. This important industrial revitalization plan marks the rise of the cultural industry to the strategic industry of the country. As a new industrial form, the network culture industry broadens the road of the cultural industry, promotes the integration of "network culture" and "economy", and becomes a new growth point for the development of cultural economy. Gradually developing into a pillar industry in the era of knowledge economy. The development of network cultural industry not only brings great economic wealth to the society, but also facilitates people's life, meets the needs of people's cultural life, and brings great spiritual wealth to people. However, the proliferation of harmful information, the right to privacy, the frequent infringement of intellectual property rights, the illegal operation of network cultural enterprises and the confusion of market management in network cultural products are one after another, affecting people's normal life and work. Seriously hindered the healthy development of network culture industry. The development of network culture industry needs not only a sound market economy system, but also effective government supervision. From the particularity of our country's network culture industry, it is the most suitable way to standardize our country's network culture industry to establish the appropriate supervision system. This paper begins with the definition of the concept of government supervision in network culture industry and analyzes the present situation of government supervision in the development of network culture industry in China on the basis of the theory of public interest and the theory of departmental interest in the economics of regulation. The network culture industry of our country has developed rapidly in recent years, and the scale of the industry has been growing continuously. However, there are still some problems in the development. Therefore, our government has taken a series of measures to supervise it and formulate relevant laws and regulations. The establishment of corresponding regulatory bodies, the implementation of a variety of regulatory forms and so on. By analyzing these supervision measures, the author points out that there are some problems in the government supervision of network culture industry, such as the imperfection of laws and regulations, the lag of government supervision mechanism, the lack of effective market supervision mechanism, etc. These problems fundamentally restrict the healthy development of China's network culture industry. Finally, from three aspects of strengthening the construction of regulations and policies of network culture industry, standardizing the supervision organization and perfecting the supervision mechanism, the paper puts forward the countermeasures and suggestions to perfect the government supervision in the development of the network culture industry in China. Strive to establish an efficient and transparent network culture industry government regulatory system.
