海峽兩岸民商事法律沖突之解決路徑

【摘要】:近年來,隨著海峽兩岸政治關(guān)系的緩和,兩岸民商事交流日益密切,法律沖突現(xiàn)象明顯。從歷史角度看,調(diào)整兩岸關(guān)系的法律受制于兩岸政治關(guān)系,并分別形成了兩個(gè)獨(dú)立的法域。在當(dāng)前兩岸合作關(guān)系背景下,如何降低政治因素對(duì)海峽兩岸民商事交流的不利影響,以法律手段化解兩岸法律沖突、推動(dòng)兩岸民商事交流、構(gòu)建互信的兩岸關(guān)系成為值得關(guān)注的問題,并成為本文的研究主題。在論證思路與觀點(diǎn)方面,本文以海峽兩岸合作關(guān)系為背景,研究化解海峽兩岸民商事領(lǐng)域法律沖突的路徑,論證了通過區(qū)際法律沖突的單向立法、兩岸協(xié)商和個(gè)案解決等多層面路徑解決兩岸民商事法律沖突的必要性與可行性。兩岸特殊的政治關(guān)系使得兩岸在各自法域內(nèi)以沖突規(guī)范的方式化解兩岸民商事法律沖突仍具有主導(dǎo)性的作用。兩岸關(guān)系的緩和推動(dòng)了兩岸民商事關(guān)系從傳統(tǒng)民事關(guān)系領(lǐng)域向經(jīng)貿(mào)關(guān)系等商事領(lǐng)域發(fā)展,這兩個(gè)領(lǐng)域的差別決定了兩岸協(xié)商在化解當(dāng)前兩岸民商事法律沖突、推動(dòng)兩岸互信的進(jìn)程中具有重要地位,海峽兩岸金融、投資、知識(shí)產(chǎn)權(quán)保護(hù)和司法協(xié)助制度安排都體現(xiàn)這一點(diǎn)。包括兩岸律師事務(wù)所在內(nèi)的私人在個(gè)案中的互動(dòng)這一路徑對(duì)降低兩岸政治因素影響、化解兩岸民商事法律沖突在當(dāng)前具有重要的作用。本文認(rèn)為,大陸地區(qū)、臺(tái)灣地區(qū)分別以司法解釋和《臺(tái)灣地區(qū)與大陸地區(qū)人民關(guān)系條例》(以下簡(jiǎn)稱“《兩岸關(guān)系條例》”)這一立法來調(diào)整兩岸民商事法律沖突問題,雙方有必要在各自的立法層面分別承認(rèn)對(duì)方法域民商事法律的效力。在論文結(jié)構(gòu)安排上,本文共分引論、本論和結(jié)論三大部分。引論部分主要論證為什么要研究這個(gè)問題以及研究的安排。本論部分包括論文的第一章至第七章。第一章主要通過展示臺(tái)灣地區(qū)、臺(tái)灣法律的特殊性來論證兩岸分別為獨(dú)立的法域,兩岸民商事法律沖突具有特殊性。第二章論證了通過兩岸協(xié)商、單向立法和個(gè)案解決這三條路徑解決海峽兩岸民商事法律沖突的可能性。其中,著重論證通過區(qū)際沖突法這一路徑來解決兩岸法律沖突的觀點(diǎn),特別是論證臺(tái)灣作為未獲得國(guó)際社會(huì)承認(rèn)的實(shí)體,大陸承認(rèn)臺(tái)灣地區(qū)的民商事法律的可行性。第三章至第六章主要實(shí)證兩岸民商事法律沖突的解決路徑中,單向方法存在局限性,應(yīng)重視兩岸協(xié)商等路徑在新時(shí)期解決兩岸民商事法律沖突的重要作用。其中,第三章從區(qū)際沖突法的角度考察了《兩岸關(guān)系條例》的緣起、地位和內(nèi)容特點(diǎn),論證了臺(tái)灣地區(qū)利用單向方法解決兩岸民商事法律沖突在很大程度上受到了政治因素的制約。第四章與第五章則從兩岸沖突法律制度、傳統(tǒng)民事領(lǐng)域沖突規(guī)范之差異角度論證單向方法存在的局限性。第六章從兩岸商事法律沖突的角度論證兩岸協(xié)商路徑的重要性。兩岸協(xié)商推動(dòng)的兩岸商事交流的興起及其引發(fā)的商事法律沖突所具有的獨(dú)特性,需要兩岸注重通過兩岸協(xié)商的方式來解決民商事法律沖突。第七章則從司法協(xié)助制度論證了兩岸協(xié)商對(duì)解決兩岸民商事法律沖突的重要作用。結(jié)論部分指出了單向立法、兩岸協(xié)商和個(gè)案解決這三條路徑在化解海峽兩岸民商事法律沖突中的重要性,大陸地區(qū)可以考慮在立法層面對(duì)臺(tái)灣地區(qū)的民商事法律的效力予以明確承認(rèn),并應(yīng)注重通過兩岸協(xié)商路徑來解決單向立法所面臨的困境。
[Abstract]:In recent years, with the easing of political relations between the two sides of the Taiwan Straits, the civil and commercial exchanges between the two sides of the Straits are increasingly close and the conflict of law is obvious. From a historical point of view, the law on the adjustment of cross-Straits relations has been subject to the political relations between the two sides of the Straits and formed two separate jurisdictions. The disadvantageous influence of the civil and commercial exchanges, dissolving the legal conflicts between the two sides of the Straits by legal means, promoting the exchange of civil and commercial affairs between the two sides of the Straits and building the mutual trust between the two sides of the Straits has become a matter of concern, and become the subject of this study. In the field of thinking and views, the paper studies and defuses the civil and commercial fields between the two sides of the Taiwan Straits. The path of the conflict of law demonstrates the necessity and feasibility of solving the conflicts between the two sides of the two sides of the Straits through the unilateral legislation of the interregional conflict of law, the cross straits consultation and the case settlement. The special political relations between the two sides make the two straits dissolve the civil and commercial legal conflicts in the way of conflict in their respective jurisdictions. The moderating relationship between the two sides of the Straits has promoted the development of the civil and commercial relations between the two sides of the Straits from the traditional civil relations to economic and trade relations. The differences between the two fields determine the importance of the cross-straits consultation in the process of resolving the current civil and commercial legal conflicts and promoting mutual trust between the two sides of the Straits, and the cross straits finance and investment, The protection of intellectual property and the arrangement of the judicial assistance system all reflect this. The path of the interaction between private and private law firms in the case has an important role in reducing the influence of the political factors between the two sides of the Straits and resolving the conflicts between the two sides of the civil and Commercial Law. The law of the people's relations between the Taiwan and the mainland (hereinafter referred to as "the regulations of the cross-strait relations") is a legislation to adjust the civil and commercial conflicts between the two sides of the Straits. It is necessary for both sides to recognize the effectiveness of the civil and commercial law of the method domain separately in their respective legislative levels. In the structure of the paper, this article is divided into three parts. The introduction part mainly demonstrates why we need to study the problem and the arrangement of the research. The first chapter includes the first chapter to the seventh chapter of the thesis. The first chapter mainly demonstrates the independence of the two straits by demonstrating the particularity of the Taiwan region and the Taiwan law, and the conflict of the law of the two sides of the two sides of the Taiwan Straits is special. The second chapter demonstrates the fact that the conflict between the two sides of the Taiwan Straits is special. Cross Straits consultation, one-way legislation and case solution to solve the three ways to solve the possibility of civil and commercial conflicts between the two sides of the Taiwan Straits. The third chapter to the sixth chapter is the main demonstration of the settlement path of the civil and commercial legal conflicts between the two sides. There are limitations in the one-way method. We should attach importance to the important role of the cross-straits negotiation in the new period to solve the conflicts between the two sides of the Taiwan Straits and commercial law. The third chapter examines the origin of the regulations of the cross-strait relations from the perspective of the interregional conflict law. The characteristics of status and content demonstrate that the use of one-way method to solve the conflict of civil and commercial law in Taiwan is greatly restricted by the political factors. The fourth chapter and the fifth chapter demonstrate the limitation of the existence of the single direction method from the legal system of the cross straits conflict and the differences of the traditional civil conflict norms. The sixth chapter is from the cross straits merchants. The importance of the negotiation between the two sides of the two sides is demonstrated by the conflict of law. The rise of the commercial and commercial exchanges between the two sides of the two straits and the uniqueness of the conflict of business laws, which are initiated by the two sides, need to be paid attention to the settlement of civil and commercial conflicts through cross-Straits negotiation. The seventh chapter demonstrates the negotiation between the two sides of the two sides from the system of judicial assistance. To solve the important role of the civil and commercial legal conflicts between the two sides of the Straits, the conclusion part points out the importance of one-way legislation, cross straits consultation and case settlement of the three paths in resolving the importance of the civil and commercial legal conflicts between the two sides of the Taiwan Straits. The mainland region can consider clearly the effect of the legislative level on the legal effect of civil and commercial law in the Taiwan region, and should pay attention to it. Cross strait consultation path to solve the dilemma faced by one-way legislation.
