【摘要】：[目的/意義]針對引進國外數(shù)據(jù)庫中的著作權(quán)相關(guān)問題,擬結(jié)合圖書館引進實踐與知識產(chǎn)權(quán)制度、合同法、競爭法,提出綜合應(yīng)對策略,降低國外數(shù)據(jù)庫引進工作的法律風險并維護圖書館自身合法權(quán)益。[方法/過程]將國外數(shù)據(jù)庫引進中的著作權(quán)相關(guān)問題進行類型化分析,歸納出實踐中的6大問題,包括國外數(shù)據(jù)庫開發(fā)者與許可方可分離性引起的合同效力風險、著作權(quán)效力不穩(wěn)定引起的合同履行風險、國外數(shù)據(jù)庫商濫用著作權(quán)采取不合理的技術(shù)保護措施、制定無法實現(xiàn)信息長期保存功能的使用規(guī)則以及收取不合理的許可使用費、制定不合理的銷售模式等。[結(jié)果/結(jié)論]針對上述問題,提出開展有針對性的著作權(quán)教育計劃、制定圖書館國外數(shù)據(jù)庫資源引進標準、注重長期保存許可的獲得、選取集體性采購聯(lián)盟模式并推動許可方的合理許可承諾、引入外部信任機制以及加強著作權(quán)風險管理等應(yīng)對策略。
[Abstract]:[objective / significance] aiming at the problems related to the introduction of copyright in foreign databases, this paper proposes a comprehensive strategy for dealing with the problems related to the introduction of library practices and the system of intellectual property rights, contract law and competition law.To reduce the legal risk of the introduction of foreign databases and to maintain the legal rights and interests of the library itself.[method / process] the problems related to copyright in the introduction of foreign databases are classified and analyzed, and six major problems in practice are summarized, including the risk of contract effectiveness caused by the separation of foreign database developers and licensees.The risk of contract performance caused by the unstable effectiveness of copyright, the abuse of copyright by foreign database providers, the adoption of unreasonable technical protection measures, the establishment of rules for the use of information that cannot be realized for a long period of time, and the collection of unreasonable licensing fees,Develop unreasonable sales patterns, etc.[results / conclusion] in view of the above problems, the author puts forward a targeted copyright education plan, formulates the standards for the introduction of foreign database resources in libraries, and pays attention to the acquisition of long-term preservation licenses.The collective purchasing alliance model is selected and the reasonable license commitment of the licensor is promoted. The external trust mechanism is introduced and the copyright risk management is strengthened.
