中華老字號(hào)知識(shí)產(chǎn)權(quán)保護(hù)問題研究

【摘要】:中華老字號(hào)具有世代傳承的獨(dú)特技藝、經(jīng)營理念和優(yōu)秀的商業(yè)文化,是中華民族彌足珍貴的文化瑰寶和財(cái)富。然而,現(xiàn)如今中華老字號(hào)的發(fā)展前景卻不容樂觀,被侵犯的案件不斷發(fā)生,究其原因,我國法律制度不完善,法律保護(hù)體系不健全,使得老字號(hào)與其他權(quán)利之間存在沖突;此外,老字號(hào)企業(yè)自身也存在諸多問題,主要是老字號(hào)企業(yè)不注重品牌維護(hù)和創(chuàng)新,知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)淡薄,知識(shí)產(chǎn)權(quán)保護(hù)機(jī)制不健全。文章通過對中華老字號(hào)發(fā)展現(xiàn)狀以及國外相關(guān)法律對商號(hào)保護(hù)制度的梳理,運(yùn)用比較的研究方法,在適合中華老字號(hào)自身特點(diǎn)的前提之下,借鑒國外的立法經(jīng)驗(yàn),提出了完善中華老字號(hào)知識(shí)產(chǎn)權(quán)保護(hù)的構(gòu)想:首先,從制度上,一方面,完善我國現(xiàn)行法律制度,明確商號(hào)權(quán)的知識(shí)產(chǎn)權(quán)屬性,效仿馳名商標(biāo)制度,建立馳名商號(hào)制度,給予老字號(hào)特殊的保護(hù),完善商號(hào)權(quán)的法律保護(hù)體系。另一方面,應(yīng)當(dāng)結(jié)合地方文化特色和老字號(hào)自身的特點(diǎn),加強(qiáng)商號(hào)保護(hù)的地方立法。將國家立法和地方立法結(jié)合起來,給老字號(hào)提供更加全面具體的保護(hù),形成一個(gè)完整的老字號(hào)保護(hù)體系。其次,從企業(yè)層面上,老字號(hào)企業(yè)要意識(shí)到知識(shí)產(chǎn)權(quán)保護(hù)的重要性,加強(qiáng)老字號(hào)知識(shí)產(chǎn)權(quán)保護(hù)的防范體制,從知識(shí)產(chǎn)權(quán)管理等方面入手完善中華老字號(hào)企業(yè)知識(shí)產(chǎn)權(quán)戰(zhàn)略。加強(qiáng)中華老字號(hào)的知識(shí)產(chǎn)權(quán)保護(hù),完善相關(guān)立法對中華老字號(hào)的發(fā)展具有重要意義,不僅保護(hù)當(dāng)事人的合法權(quán)益,同時(shí)也保障了社會(huì)經(jīng)濟(jì)健康有序的發(fā)展,促進(jìn)文化的傳承。
[Abstract]:With unique skills, business philosophy and excellent business culture, the old Chinese brand is the precious cultural treasure and wealth of the Chinese nation.However, nowadays, the development prospect of the old Chinese brands is not optimistic, and the cases of infringement have occurred constantly. The reasons are that the legal system is not perfect and the legal protection system is not perfect, which makes the conflicts between the old brands and other rights exist.In addition, there are many problems in the old brand enterprises, mainly because they don't pay attention to the brand maintenance and innovation, the consciousness of intellectual property protection is weak, and the mechanism of intellectual property protection is not perfect.By combing the current situation of the development of old Chinese brands and the relative laws of foreign countries on the protection system of trade names, using comparative research methods, under the premise of adapting to the characteristics of old Chinese brands, the article draws lessons from foreign legislative experience.First of all, from the system point of view, we should perfect the current legal system of our country, clarify the intellectual property attribute of the trade name right, emulate the well-known trademark system, and establish the well-known trade name system.To give special protection to old-name, perfect the legal protection system of the right of trade name.On the other hand, we should strengthen the local legislation of trade name protection by combining the local cultural characteristics and the characteristics of old brands.Combine national legislation with local legislation to provide more comprehensive and concrete protection to old brands and form a complete protection system for old brands.Secondly, from the enterprise level, the old enterprise should realize the importance of intellectual property protection, strengthen the protection system of the old brand intellectual property, and improve the intellectual property strategy of the old Chinese enterprise from the aspects of intellectual property management and so on.It is of great significance to strengthen the intellectual property protection of old Chinese brands and perfect the relevant legislation. It not only protects the legitimate rights and interests of the parties, but also ensures the healthy and orderly development of social economy and promotes the cultural inheritance.
