【摘要】：發(fā)達(dá)國(guó)家不同歷史時(shí)期的實(shí)踐證明,專利制度的運(yùn)行事關(guān)國(guó)家的發(fā)展方向和經(jīng)濟(jì)結(jié)構(gòu),以及一國(guó)技術(shù)創(chuàng)新的策略選擇。專利制度的廣泛應(yīng)用和專利技術(shù)的市場(chǎng)轉(zhuǎn)化深受一國(guó)科技體制的制約。專利制度經(jīng)常被用來促進(jìn)國(guó)家的重點(diǎn)產(chǎn)業(yè)和保護(hù)弱小的民族工業(yè),同時(shí)也受產(chǎn)業(yè)轉(zhuǎn)型的影響。專利制度還在諸多環(huán)節(jié)可以起到保障公共利益的作用。因此,我國(guó)在實(shí)現(xiàn)國(guó)家治理現(xiàn)代化的過程中應(yīng)當(dāng)加強(qiáng)知識(shí)產(chǎn)權(quán)戰(zhàn)略的細(xì)化落實(shí)和階段調(diào)整,創(chuàng)新科技體制機(jī)制以適應(yīng)專利研發(fā)和轉(zhuǎn)化的需要,優(yōu)化產(chǎn)業(yè)的專利布局和結(jié)構(gòu),在專利立法和施行中兼顧公共利益。
[Abstract]:Practice in different historical periods in developed countries has proved that the operation of patent system is related to the development direction and economic structure of the country. The extensive application of the patent system and the transformation of the market of patent technology are restricted by the technological system of one country. The patent system is often used to promote the national key industries and to protect the weak national industries. At the same time, it is also affected by the industrial transformation. The patent system can also play a role in protecting the public interest in many aspects. Therefore, in the process of realizing the modernization of national governance, China should strengthen the detailed implementation and phase adjustment of the intellectual property strategy. In order to meet the needs of patent research and development and transformation, to optimize the patent layout and structure of the industry, and to give consideration to the public interests in patent legislation and implementation.
