【摘要】:計(jì)算機(jī)游戲是在電子計(jì)算機(jī)上運(yùn)行,具有娛樂(lè)功能的計(jì)算機(jī)軟件。它是一種新興的娛樂(lè)方式,同時(shí)也是一個(gè)新興的產(chǎn)業(yè)部門(mén),在吸引了成千上萬(wàn)玩家的同時(shí),也帶來(lái)了巨大的經(jīng)濟(jì)效益。我國(guó)的計(jì)算機(jī)游戲產(chǎn)業(yè)雖然與其他發(fā)達(dá)國(guó)家相比起步較晚,但是在加入WTO以后,隨著計(jì)算機(jī)在家庭使用的普及,人民群眾對(duì)計(jì)算機(jī)游戲的需求也迅速增加,計(jì)算機(jī)游戲產(chǎn)業(yè)迎來(lái)了一個(gè)飛速發(fā)展的階段。計(jì)算機(jī)游戲從誕生到現(xiàn)在已經(jīng)成為一個(gè)熱門(mén)的產(chǎn)業(yè),,并且進(jìn)入了相對(duì)成熟的時(shí)期。 但是隨著游戲產(chǎn)業(yè)的迅猛發(fā)展,對(duì)計(jì)算機(jī)游戲的知識(shí)產(chǎn)權(quán)保護(hù)卻滯后于這一速度。游戲市場(chǎng)繁榮的背后存在著一系列亟待解決的問(wèn)題。如果這些問(wèn)題不能得到有效的解決,將極大影響我國(guó)游戲產(chǎn)業(yè)市場(chǎng)的健康發(fā)展。 計(jì)算機(jī)游戲軟件作為一種計(jì)算機(jī)程序受到著作權(quán)法的保護(hù),未經(jīng)權(quán)利人許可對(duì)計(jì)算機(jī)游戲軟件的復(fù)制是侵害計(jì)算機(jī)程序作品復(fù)制權(quán)的行為,改寫(xiě)程序代碼的行為也可能侵害到軟件的改編權(quán)和保持作品完整性權(quán)。然而,相對(duì)于其他計(jì)算機(jī)程序,一款計(jì)算機(jī)游戲往往綜合畫(huà)面、音樂(lè)與劇本于一體,這就涉及到游戲中的畫(huà)面、音樂(lè)、文字等一系列連鎖的著作權(quán)保護(hù)問(wèn)題。計(jì)算機(jī)游戲表現(xiàn)出一種計(jì)算機(jī)軟件和類似影視作品的雙重屬性。各國(guó)對(duì)于游戲軟件的保護(hù),也采取了區(qū)別與一般計(jì)算機(jī)軟件的方法。 本文首先闡述計(jì)算機(jī)游戲的特征及其與著作權(quán)的關(guān)系,從美國(guó)、日本等國(guó)的具體案例出發(fā),結(jié)合理論從計(jì)算機(jī)游戲的法律定位、侵權(quán)判定等各方面進(jìn)行分析,闡明了國(guó)外對(duì)計(jì)算機(jī)游戲法律保護(hù)的情況。最后對(duì)中國(guó)的計(jì)算機(jī)游戲保護(hù)的現(xiàn)狀進(jìn)行分析,并提出一點(diǎn)建議,以期對(duì)促進(jìn)中國(guó)的計(jì)算機(jī)游戲的著作權(quán)保護(hù)提供一些助益。
[Abstract]:Computer games are computer software that runs on electronic computers and has entertainment functions. It is a new form of entertainment and an emerging industry department, attracting thousands of players at the same time. China's computer game industry started late compared with other developed countries, but after China's entry into WTO, with the popularity of computers in the home, The people's demand for computer games has also increased rapidly, and the computer game industry has ushered in a stage of rapid development. Computer games have become a hot industry from birth to now, and have entered a relatively mature period. However, with the rapid development of the game industry, the intellectual property protection of computer games lags behind this speed. There are a series of problems that need to be solved urgently behind the prosperity of the game market. Will greatly affect the healthy development of China's game industry market. As a kind of computer program, computer game software is protected by copyright law. Rewriting code can also infringe upon the right to adapt the software and preserve the integrity of the work. However, compared to other computer programs, a computer game tends to integrate pictures, music and scripts. This involves a series of issues of copyright protection, such as screen, music, text, etc. Computer games show a dual attribute of computer software and similar film and television works. The method of differentiating from general computer software is also adopted. This paper first describes the characteristics of computer games and their relationship with copyright, starting from the specific cases of the United States, Japan and other countries, combined with the theory of computer games from the legal positioning, infringement determination and other aspects of the analysis. This paper expounds the situation of the legal protection of computer games abroad, and finally analyzes the present situation of the protection of computer games in China, and puts forward some suggestions in order to provide some help for promoting the copyright protection of computer games in China.
