【摘要】：毫無(wú)疑問(wèn),知識(shí)產(chǎn)權(quán)法應(yīng)當(dāng)選擇恰當(dāng)?shù)哪Ｊ饺谌胛覈?guó)未來(lái)民法典,但選擇何種模式才為知識(shí)產(chǎn)權(quán)法恰當(dāng)?shù)厝氲浞绞讲o(wú)定論,事實(shí)上,爭(zhēng)論的根源乃是基于民法學(xué)者與知識(shí)產(chǎn)權(quán)學(xué)者所站立場(chǎng)不同。因而,知識(shí)產(chǎn)權(quán)法入典之前提,即是在兩者"交涉"的基礎(chǔ)之上,堅(jiān)持其內(nèi)容的協(xié)調(diào)與邏輯性原則,堅(jiān)持構(gòu)建體系的穩(wěn)定性原則;堅(jiān)持構(gòu)建體系的開(kāi)放性原則尋求共識(shí),而后在民法典總則之中恰當(dāng)安排知識(shí)產(chǎn)權(quán)法。
[Abstract]:There is no doubt that the intellectual property law should choose the appropriate model to be integrated into the future civil code of our country, but there is no conclusion as to which mode is the proper way of entering the intellectual property law. In fact, The root of the dispute is based on the different positions of civil jurists and intellectual property scholars. Therefore, the premise of the entry of intellectual property law is to adhere to the principle of coordination and logicality of its contents on the basis of "negotiation" between the two parties. Adhere to the stability of the construction of the system, adhere to the open principle of building the system to seek consensus, and then appropriate arrangements in the general provisions of the Civil Code intellectual property law.
