【摘要】：宗教財產(chǎn)是宗教在俗世社會中生存與發(fā)展的物質(zhì)依托,也為宗教界傳播信仰、實踐教旨、服務(wù)信眾、造福社會等開展一系列與信仰宗旨和教義教規(guī)相關(guān)的宗教活動提供了經(jīng)濟保障。宗教財產(chǎn)既是政治問題、社會問題,又是法律問題。確切的說,主要是民法財產(chǎn)權(quán)方面的問題。全文除引言外和結(jié)語外,分為四部分： 第一部分,我國宗教財產(chǎn)概述。首先,在介紹我國法律法規(guī)對宗教財產(chǎn)定義的基礎(chǔ)上,對宗教財產(chǎn)的特點進行分析。進而將宗教財產(chǎn)放入了物權(quán)、債權(quán)、繼承權(quán)、知識產(chǎn)權(quán)法律關(guān)系中進行探討。 第二部分,我國宗教財產(chǎn)民事保護的法律實踐。在分析我國宗教財產(chǎn)民事保護的現(xiàn)狀中,從宗教財產(chǎn)的保護、宗教財產(chǎn)管理的制度規(guī)范、宗教財產(chǎn)用途的管理規(guī)范的角度,對我國宗教財產(chǎn)保護所涉及的法律法規(guī)進行了梳理,提出了宗教財產(chǎn)的立法不足。稍后結(jié)合相關(guān)法律實踐,對典型的宗教財產(chǎn)保護案例從民事法律的角度進行分析。 第三部分,宗教財產(chǎn)法律保護的比較法分析。以日本和美國兩個有著成功財產(chǎn)保護經(jīng)驗的國家為例,分別介紹了兩國在宗教財產(chǎn)民事保護上的主要做法和亮點,最后就兩國關(guān)于宗教財產(chǎn)保護的共通之處,總結(jié)出我國可以借鑒的宗教總財產(chǎn)保護立法模式。 第四部分,完善我國宗教財產(chǎn)民事保護的思考和建議。以宗教財產(chǎn)民事保護的立法思想為先導(dǎo),繼而從宗教財產(chǎn)權(quán)利主體地位,宗教財產(chǎn)目的性使用、宗教財產(chǎn)的權(quán)利救濟途徑三方面提出宗教財產(chǎn)民事保護的具體建議。
[Abstract]:Religious property is the material support for the survival and development of religion in the worldly society. It also disseminates beliefs, practices religious tenets, and serves believers for the religious community. For the benefit of society, a series of religious activities related to the purposes of belief and dogma provide economic security. Religious property is both a political, a social and a legal issue. To be exact, religious property is not only a political issue, but also a legal one. In addition to the introduction and conclusion, the full text is divided into four parts:. First of all, on the basis of introducing the definition of religious property in China's laws and regulations, the characteristics of religious property are analyzed, and then the religious property is put into real right, creditor's right, inheritance right, To discuss the legal relationship of intellectual property. The second part, the legal practice of civil protection of religious property in our country. In the analysis of the current situation of civil protection of religious property in China, from the perspective of the protection of religious property, the system of management of religious property, the management norms of the use of religious property, This paper combs the laws and regulations involved in the protection of religious property in our country, and points out that the legislation of religious property is insufficient. Later, combined with the relevant legal practice, the typical case of protection of religious property is analyzed from the angle of civil law. The third part, the comparative law analysis of the legal protection of religious property. Taking two countries with successful property protection experience, Japan and the United States as examples, the paper introduces the main practices and highlights of the two countries in the civil protection of religious property. Finally, on the common points of the two countries on the protection of religious property, summed up our country can learn from the general protection of religious property legislation model. The fourth part, the perfect our country religious property civil protection thought and the suggestion. Take the religious property civil protection legislation thought as the forerunner, then from the religious property right main body status, the religious property purpose uses, The concrete suggestions of civil protection of religious property are put forward in three aspects of the right relief of religious property.
