【摘要】：中藥秘方屬于中國(guó)傳統(tǒng)醫(yī)學(xué)知識(shí)的有機(jī)部分,存在形式各異,來(lái)源多元,療效以國(guó)家級(jí)保密方劑、中醫(yī)藥老字號(hào)秘方以及中醫(yī)院的院內(nèi)制劑最為顯著,實(shí)屬一筆可以更廣泛地加以挖掘的醫(yī)療資源。但目前只有國(guó)家級(jí)保密方劑可以不公開技術(shù)秘密就能生產(chǎn)上市,其他秘方或被限定在一個(gè)較小的范圍內(nèi)使用,或因不能注冊(cè)生產(chǎn)而被束之高閣,此乃中藥秘方之悲哀。秘方困境之根本在于保護(hù)傳統(tǒng)醫(yī)學(xué)知識(shí)的邏輯與現(xiàn)代知識(shí)產(chǎn)權(quán)制度的專利保護(hù)措施實(shí)為一種不可兼容的關(guān)系,需要另辟途徑,找到一條解開秘方之秘的道路。為此,建議將聯(lián)合國(guó)《生物多樣性公約》有關(guān)生物資源開發(fā)以及相關(guān)傳統(tǒng)知識(shí)利用的"惠益分享"原則,借用到解開秘方之秘的努力之中,為提高公民健康水平做出貢獻(xiàn)。
[Abstract]:The secret prescription of traditional Chinese medicine is an organic part of Chinese traditional medical knowledge. It has different forms and diverse sources. The curative effects are most remarkable in the state-level secret prescription, the secret prescription of the old name of traditional Chinese medicine and the hospital preparations in the Chinese medicine hospital. It is a medical resource that can be excavated more widely. But at present, only national secret prescriptions can be produced and marketed without disclosure of technical secrets, and other secret prescriptions may be used in a smaller scope. This is the sorrow of the secret prescription of traditional Chinese medicine. The root of the dilemma lies in the incompatibility between the logic of protecting traditional medical knowledge and the patent protection measures of the modern intellectual property system. Another way is needed to find a way out of the mystery. To this end, it is recommended that the "benefit-sharing" principles of the United Nations Convention on Biological Diversity relating to the development of biological resources and the use of relevant traditional knowledge be brought to bear, Borrow the secret of the secret of the efforts to improve the health of citizens to contribute.
