【摘要】：方法專利的延伸保護之所以在專利制度的構(gòu)建中受到廣泛關(guān)注和討論，是因為在作為核心問題的專利權(quán)保護范圍上存在著許多比較多難以調(diào)和的矛盾和相對比較復(fù)雜的利益關(guān)系。比如什么樣的方法專利可以獲得延伸保護，以及延伸保護適用范圍的邊界究竟在哪里�！杜c貿(mào)易有關(guān)的知識產(chǎn)權(quán)協(xié)議》(TRIPS)的相關(guān)規(guī)定以及各個國家和地區(qū)的相關(guān)規(guī)定不盡相同，在具體司法適用中也如此，由此可見方法專利的延伸保護問題爭議之大。本文旨在對方法專利延伸保護的概念、特點、產(chǎn)生的必要性進行闡述，結(jié)合不同國家和地區(qū)對方法專利延伸保護問題的立法和司法實踐，進而對我國方法專利延伸保護相關(guān)規(guī)定的完善提出構(gòu)想。 本文共分為三章。第一章是對方法專利延伸保護的概述。由于方法專利的延伸保護從本質(zhì)上來說是專利權(quán)保護范圍認定原則的一個“例外”，該章節(jié)主要談?wù)摿朔椒▽＠陨淼奶厥庑�，，闡述了基于該特殊性基礎(chǔ)之上的，方法專利延伸保護存在的必要性。并結(jié)合我國對方法專利延伸保護的立法沿革和在具體司法適用中的指導(dǎo)案例，對方法專利延伸保護在我國的現(xiàn)狀和不足進行了分析。 第二章具體分析了可以適用延伸保護的方法專利客體的范圍，以及方法專利延伸保護的產(chǎn)品范圍，并結(jié)合了世界不同國家和地區(qū)的立法和司法實踐對上述問題進行了討論和總結(jié)。 第三章結(jié)合前兩章提出的問題，提出了完善我國方法專利延伸保護規(guī)定的的方向和建議。本章提出，我國應(yīng)該在專利法中，一方面明確只對產(chǎn)品的“本性”發(fā)生重大影響的制造方法專利適用延伸保護，另一方面適當(dāng)擴大對“依照方法專利直接獲得的產(chǎn)品”的界定范圍，至不改變“本性”的后續(xù)產(chǎn)品。
[Abstract]:The reason why the extended protection of method patent has been widely concerned and discussed in the construction of patent system, This is because there are many more difficult contradictions and relatively complex interests in the scope of patent protection, which is the core issue. For example, what kind of method patents can be extended to protect? And where exactly are the boundaries that extend the scope of protection. The relevant provisions of the trips Agreement and the relevant provisions of different countries and regions are different, and the same is true in the specific judicial application, This paper aims to expound the concept, characteristics and necessity of method patent extension protection. Combined with the legislation and judicial practice of the method patent extension protection in different countries and regions, this paper puts forward some ideas on the perfection of the relevant provisions of the method patent extension protection in China. This paper is divided into three chapters. The first chapter is an overview of the method patent extension protection. Since the method patent extension protection is essentially an "exception" to the principle of patent protection scope determination, this chapter mainly discusses. The particularity of the method patent itself, This paper expounds the necessity of the method patent extension protection based on this particularity, and combines the legislative evolution of the method patent extension protection in our country and the guiding cases in the specific judicial application. The present situation and deficiency of method patent extension protection in China are analyzed. The second chapter analyzes the scope of the method patent object which can be applied to the extension protection, and the product scope of the method patent extension protection. And combined with the legislation and judicial practice of different countries and regions in the world, the above problems are discussed and summarized. The third chapter combines the questions raised in the first two chapters, and puts forward the direction and suggestions of perfecting the provisions of the extended protection of method patents in our country. This chapter proposes that China should be in the patent law. On the one hand, it is clear that the extended protection of manufacturing method patents, which only have a significant impact on the "nature" of the products, and on the other hand, the scope of the definition of "products directly obtained in accordance with the method patent" is appropriately expanded, A follow-up product that does not change "nature".
