【摘要】：在當(dāng)今的知識(shí)經(jīng)濟(jì)時(shí)代,隨著科技的迅猛發(fā)展和全球經(jīng)濟(jì)一體化的深度融合,我國(guó)的科技型中小企業(yè)在市場(chǎng)經(jīng)濟(jì)發(fā)展中呈現(xiàn)出良好的發(fā)展勢(shì)頭,在市場(chǎng)經(jīng)濟(jì)中所占的份額越來越大,科技型中小企業(yè)在穩(wěn)定經(jīng)濟(jì)、緩解就業(yè)壓力、優(yōu)化投資結(jié)構(gòu)方面具有舉足輕重的作用。科技中小企業(yè)尤其高新技術(shù)企業(yè)成為推動(dòng)經(jīng)濟(jì)增長(zhǎng)的主要力量,推動(dòng)新型經(jīng)濟(jì)發(fā)展。然而,科技型中小企業(yè)的成長(zhǎng)需要大量資金,缺乏資金、融資困難已經(jīng)成為制約我國(guó)科技型中小企業(yè)生存和發(fā)展的瓶頸。現(xiàn)實(shí)中,有形資產(chǎn)往往不是科技型中小企業(yè)資產(chǎn)的重要部分,以專利、商標(biāo)、軟件著作權(quán)、集成電路布圖、商業(yè)秘密等知識(shí)產(chǎn)權(quán)為代表的無形資產(chǎn)才是其核心資產(chǎn)。知識(shí)產(chǎn)權(quán)質(zhì)押為科技型中小企業(yè)融資提供了一種全新融資途徑。在國(guó)外發(fā)達(dá)國(guó)家,知識(shí)產(chǎn)權(quán)擔(dān)保融資已經(jīng)取得了巨大進(jìn)步,為企業(yè)的持續(xù)發(fā)展提供動(dòng)力。在我國(guó),由于知識(shí)產(chǎn)權(quán)質(zhì)押制度起步相對(duì)較晚,現(xiàn)有的法律與相關(guān)的配套制度不盡完善,加上知識(shí)產(chǎn)權(quán)自身所具有的特殊性,導(dǎo)致了在質(zhì)押融資過程中給相關(guān)權(quán)利人帶來了不確定的風(fēng)險(xiǎn),挫傷了銀行等金融機(jī)構(gòu)向科技型中小企業(yè)貸款的積極性。本文以我國(guó)科技型中小企業(yè)為對(duì)象,以知識(shí)產(chǎn)權(quán)質(zhì)押為主線,對(duì)我國(guó)科技型中小企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資現(xiàn)狀以及成因進(jìn)行全面剖析:一是分析我國(guó)科技型中小企業(yè)知識(shí)產(chǎn)權(quán)融資現(xiàn)狀,找出問題實(shí)質(zhì);二是研究知識(shí)產(chǎn)權(quán)融資方式在科技型中小企業(yè)中的可行性并找出進(jìn)行知識(shí)產(chǎn)權(quán)融資時(shí)所產(chǎn)生的問題,從而對(duì)其進(jìn)行分析找出對(duì)策;三是希望能對(duì)完善知識(shí)產(chǎn)權(quán)質(zhì)押融資理論體系和解決科技型中小企業(yè)融資難這一現(xiàn)實(shí)性問題有所幫助。通過研究發(fā)現(xiàn):我國(guó)科技型中小企業(yè)目前雖得到國(guó)家的高度關(guān)注,但是扶持力度和范圍還不夠,不同地域開展科技型中小企業(yè)知識(shí)產(chǎn)權(quán)融資的程度參差不齊,尚處于發(fā)展的初級(jí)階段,存在知識(shí)產(chǎn)權(quán)質(zhì)押融資應(yīng)用范圍有限等問題。關(guān)于我國(guó)科技型中小企業(yè)知識(shí)產(chǎn)權(quán)融資還尚有許多問題需要我們?nèi)ヌ剿餮芯?力爭(zhēng)為我國(guó)科技型中小企業(yè)的發(fā)展提供更好的理論依據(jù)和支持。
[Abstract]:In the era of knowledge economy, with the rapid development of science and technology and the deep integration of global economic integration, the small and medium-sized scientific and technological enterprises in China have shown a good momentum of development in the development of market economy. The share in the market economy is increasing. Small and medium-sized technology-based enterprises are stabilizing the economy and easing the pressure on employment. The optimization of investment structure plays an important role. Small and medium-sized technological enterprises, especially high-tech enterprises, have become the main force to promote economic growth and promote new economic development. However, the growth of small and medium-sized technological enterprises needs a lot of capital. Lack of funds, financing difficulties have become a bottleneck restricting the survival and development of small and medium-sized science and technology enterprises in China. In reality, tangible assets are often not an important part of the assets of small and medium-sized technological enterprises, with patents, trademarks, software copyrights, The intangible assets such as integrated circuit layout, trade secret and other intellectual property rights are its core assets. Intellectual property pledge provides a new financing way for small and medium-sized technological enterprises. IPR secured financing has made great progress, which provides impetus for the sustainable development of enterprises. In our country, because the intellectual property pledge system started relatively late, the existing laws and related supporting systems are not perfect. In addition, the particularity of intellectual property itself leads to the uncertain risk to the relevant obligee in the process of pledge financing. This paper takes the small and medium-sized technological enterprises as the object and the intellectual property pledge as the main line. The present situation and causes of intellectual property rights pledge financing of science and technology small and medium-sized enterprises in China are comprehensively analyzed: first, to analyze the current situation of intellectual property financing of science and technology small and medium-sized enterprises in China, and to find out the essence of the problem; The second is to study the feasibility of intellectual property financing in small and medium-sized technological enterprises and to find out the problems arising in the process of intellectual property financing, so as to analyze and find out the countermeasures; Third, it is hoped that it will be helpful to improve the theoretical system of intellectual property pledge financing and to solve the practical problem of financing difficulties for technology-based SMEs. However, the strength and scope of support are not enough. The degree of intellectual property financing for small and medium-sized scientific and technological enterprises in different regions is not uniform, and is still in the initial stage of development. There are still some problems such as the limited application of intellectual property pledge financing. There are still many problems about intellectual property financing of small and medium-sized technological enterprises in China that need us to explore and study. Strive to provide better theoretical basis and support for the development of science and technology-based medium-sized enterprises in China.
