【摘要】：隨著我國經(jīng)濟的發(fā)展和社會的進步,知識產(chǎn)權(quán)案件也越來越多。高效地處理知識產(chǎn)權(quán)糾紛是當事人的迫切心愿,也是法律工作者義不容辭的責任。在專利侵權(quán)訴訟中,被控侵權(quán)人往往向?qū)＠麖?fù)審委員會請求宣告專利權(quán)無效,這就要在專利侵權(quán)訴訟程序之外走另外一個程序,即專利無效宣告程序。如何協(xié)調(diào)好這兩個程序直接關(guān)系到案件的處理效率,是一個值得認真研究的問題。 本文從專利無效宣告程序和侵權(quán)訴訟程序的關(guān)系出發(fā),旨在探討協(xié)調(diào)兩個程序的方法。借鑒美國和日本的司法實踐,結(jié)合我國情況,探討適合我國的解決知識產(chǎn)權(quán)糾紛的方法。全文分為前言、正文、結(jié)語三個部分,正文共包括三章。 第一章介紹專利無效宣告的基本情況,包括四個部分。第一部分介紹我國專利無效宣告程序,第二部分講述該程序的特點,第三部分說明該程序存在的弊端,第四部分介紹幾個知識產(chǎn)權(quán)大國的專利無效宣告程序。 第二章說明專利無效抗辯制度的情況,主要從美國和日本的情況加以說明。探尋將其移植到中國的切入點。因為司法體制等原因,暫時尚且不能采納美國賦予法院最終確認專利權(quán)效力的做法,但在專利權(quán)確權(quán)機制方面,我國可以借鑒日本的制度作為過渡措施。 第三章主要論述協(xié)調(diào)專利無效宣告程序和侵權(quán)訴訟程序的幾點建議,如專利無效抗辯、現(xiàn)有技術(shù)抗辯和中止侵權(quán)訴訟等。統(tǒng)一專利確權(quán)與專利侵權(quán)訴訟的判定標準,建立知識產(chǎn)權(quán)高等法院對專利確權(quán)和專利侵權(quán)案件做統(tǒng)一的上訴審理,這樣兩個程序的結(jié)果就因此而統(tǒng)一。
[Abstract]:With the development of economy and society in our country, more and more intellectual property cases have been brought. It is the urgent wish of the parties to deal with intellectual property disputes efficiently, and it is also the duty of the legal workers. The alleged infringer often requests the Patent Reexamination Board to declare the patent right null and void, which requires that another procedure be taken in addition to the patent infringement proceedings. That is, patent invalidation procedure. How to coordinate these two procedures directly related to the processing efficiency of cases is a problem worthy of careful study. Starting from the relationship between patent invalidation procedure and tort procedure, this paper aims to discuss the methods of coordinating the two procedures. The author draws lessons from the judicial practice of the United States and Japan, and combines the situation of our country. This paper is divided into three parts: preface, text and conclusion, and the text includes three chapters. The first chapter introduces the basic situation of patent invalidation declaration, including four parts. The first part introduces the procedure of declaring patent invalidation in our country, the second part describes the characteristics of the procedure, the third part explains the disadvantages of the procedure. Part 4th introduces the patent invalidation procedure of several intellectual property countries. The second chapter explains the situation of patent invalidity defense system, mainly from the United States and Japan. Explore the point of entry to transplant it to China. Because of the judicial system and other reasons, It is not possible for the United States to grant the court the final confirmation of the validity of the patent right for the time being, but China can learn from the Japanese system as a transitional measure in the mechanism of patent right confirmation. The third chapter mainly discusses several suggestions to coordinate the procedure of patent invalidation declaration and infringement proceedings, such as patent invalidation defense, existing technology defense and suspension of infringement action, etc. The establishment of the High Court of intellectual property right to make a unified appeal against patent confirmation and patent infringement cases, so that the results of the two procedures are unified.
