【摘要】：自20世紀(jì)初廣播技術(shù)誕生以來，其作為一種新的傳播媒介逐步進(jìn)入社會公眾的家庭，成為公眾了解信息、獲取知識的重要平臺。廣播電臺、電視臺這些組織在節(jié)目傳播的過程中，投入了大量的人力和物力，但在現(xiàn)實(shí)生活中，一些不法分子常常盜播廣播信號來牟取非法利益。為了保護(hù)廣播組織的利益，許多國家都在著作權(quán)法中規(guī)定了保護(hù)廣播組織利益的條款。在國際上，1961年制定的《羅馬公約》規(guī)定了對廣播組織權(quán)的保護(hù)，同時確立了之后各國國內(nèi)廣播組織權(quán)保護(hù)的基本框架。 歷史的車輪不斷前行，科學(xué)技術(shù)發(fā)展的腳步也從不停歇。廣播技術(shù)的發(fā)展經(jīng)歷了從無線廣播到有線廣播，從模擬化電子信號廣播到數(shù)字化電子信號廣播的變革。目前，第六次信息技術(shù)革命已經(jīng)蒞臨，這是以電子計算機(jī)技術(shù)為主導(dǎo)的高度綜合現(xiàn)在高科技的多媒體技術(shù)信息革命。在這一過程中，一些不法分子利用新技術(shù)來盜播廣播節(jié)目信號，有的通過計算機(jī)暫時復(fù)制或錄制廣播信號，有的利用互聯(lián)網(wǎng)傳播錄制下來的廣播信號，還有的將廣播節(jié)目錄制下來并刻成光盤大量銷售。面對花樣繁多的盜播行為，廣播組織感到其利益受到前所未有的威脅，強(qiáng)烈要求提高網(wǎng)絡(luò)環(huán)境中的利益保護(hù)水平。 為此，許多國家開始修訂著作權(quán)法來加強(qiáng)對廣播組織的利益保護(hù)。國際社會也對此做出了努力。從1998年開始，世界知識產(chǎn)權(quán)組織版權(quán)及相關(guān)委員會已連續(xù)召開了25屆會議，來討論一個保護(hù)廣播組織權(quán)的國際公約的制定。2006年9月，終于擬定了《世界知識產(chǎn)權(quán)組織廣播組織條約草案》，（以下簡稱《廣播組織條約草案》），這是目前關(guān)于保護(hù)廣播組織權(quán)利的最新的法律文本。雖然因?yàn)榕c會的發(fā)達(dá)國家和發(fā)展中國家對該草案的規(guī)定分歧很大，該草案迄今為止尚未通過，但其對廣播組織權(quán)全面細(xì)致的規(guī)定，已經(jīng)為各國立法關(guān)于廣播組織權(quán)的修訂指出了一個新方向。 我國現(xiàn)行《著作權(quán)法》對廣播組織權(quán)給予了專門保護(hù)，但規(guī)定非常粗疏，并且因?yàn)檠赜昧恕读_馬公約》中的規(guī)定，隨著數(shù)字技術(shù)與廣播技術(shù)的廣泛應(yīng)用，早已不能有效地保護(hù)廣播組織的利益。筆者認(rèn)為，為了充分保護(hù)廣播組織的合法權(quán)利，我國應(yīng)該保持對《廣播組織條約草案》動向的密切關(guān)注，對我國著作權(quán)法做相應(yīng)的修改，以完善我國的廣播組織權(quán)利保護(hù)制度。 本文從結(jié)構(gòu)上共分為五個部分： 第一部分是廣播組織權(quán)的概述。介紹了廣播組織權(quán)如何產(chǎn)生，以及界定了這一權(quán)利的概念。然后對保護(hù)廣播組織權(quán)的國際公約進(jìn)行了梳理，其中，WIPO擬定的《廣播組織條約草案》是目前國際社會有關(guān)廣播組織權(quán)的最新法律文本。 第二部分是網(wǎng)絡(luò)環(huán)境下廣播組織權(quán)主體的更新。首先通過闡述傳統(tǒng)廣播組織的概念和類型，分析了傳統(tǒng)環(huán)境下廣播組織的范圍。其次對網(wǎng)絡(luò)環(huán)境下新出現(xiàn)的網(wǎng)絡(luò)廣播方式和網(wǎng)絡(luò)廣播組織進(jìn)行了分析，重點(diǎn)討論了網(wǎng)絡(luò)廣播組織的含義和范圍。 第三部分是網(wǎng)絡(luò)環(huán)境下廣播組織權(quán)內(nèi)容的變遷。這一部分針對網(wǎng)絡(luò)環(huán)境下廣播組織面臨的各種問題，以《羅馬公約》的規(guī)定為基礎(chǔ)，以《廣播組織條約草案》為參考，闡述了廣播組織傳統(tǒng)的四項(xiàng)權(quán)利內(nèi)容在新形勢下的變遷，以及解讀了《廣播組織條約草案》中新增加的三項(xiàng)權(quán)利。 第四部分是網(wǎng)絡(luò)環(huán)境下廣播組織權(quán)的限制與例外。利益平衡原則是著作權(quán)法的一項(xiàng)基本原則。在擴(kuò)張廣播組織的主體和權(quán)利范圍時，必須注意保持與社會公眾利益的平衡。從廣播組織權(quán)的合理使用制度和保護(hù)期限兩個方面分析，主張對網(wǎng)絡(luò)環(huán)境下廣播組織權(quán)保護(hù)予以適當(dāng)限制。 第五部分為我國網(wǎng)絡(luò)環(huán)境下的廣播組織權(quán)的立法完善。因?yàn)檠赜谩读_馬公約》對廣播組織權(quán)的規(guī)定，我國著作權(quán)法中的某些相關(guān)規(guī)定已不能適應(yīng)如今的信息技術(shù)發(fā)展?fàn)顩r。本文在前述解讀和分析的基礎(chǔ)上，，從權(quán)利主體、權(quán)利內(nèi)容、權(quán)利保護(hù)與權(quán)利限制四個方面分別論述了應(yīng)該如何完善我國網(wǎng)絡(luò)環(huán)境下的廣播組織權(quán)利保護(hù)制度。
[Abstract]:Since the birth of broadcasting technology in the early 20th century , as a new medium of communication , it has entered the family of the public and becomes the important platform for the public to know the information and acquire knowledge . In the course of the dissemination of the program , the broadcasting station and the television station have invested a lot of manpower and material resources . In order to protect the interests of the broadcasting organizations , many countries have set out the protection of the interests of broadcasting organizations in copyright law . At the international level , the Rome Convention , established in 1961 , lays down the protection of the rights of broadcasting organizations , and establishes the basic framework for the protection of the rights of broadcasting organizations in various countries . The development of science and technology has never stopped . The development of broadcasting technology has gone through the revolution from radio to cable broadcasting , broadcasting from analog electronic signal to digital electronic signal broadcasting . At present , the sixth information technology revolution has come . At present , the sixth information technology revolution has come to come . In September 2006 , the Copyright and Related Commission of the World Intellectual Property Organization ( WIPO ) has held 25 sessions to discuss the development of an international convention on the protection of the rights of broadcasting organizations . It introduces how the rights of broadcasting organizations are generated , and defines the concept of this right . Then the international conventions for protecting the rights of broadcasting organizations are reviewed . Among them , the draft treaty on broadcasting organizations prepared by WIPO is the latest legal text of the current international community ' s right to broadcasting organizations . The second part is the updating of broadcasting organization right main body in the network environment . Firstly , through the elaboration of the concept and type of the traditional broadcasting organization , the scope of the broadcasting organization in the traditional environment is analyzed . Secondly , the new network broadcasting method and the network broadcasting organization in the network environment are analyzed , and the meaning and range of the network broadcasting organization are discussed . The third part is the change of the content of broadcasting organization right under the network environment . This part aims at the problems faced by the broadcasting organizations in the network environment , based on the stipulation of the Rome Convention , expounds the changes of the four rights contents of the traditional broadcasting organization under the new situation , and interprets the three rights newly added in the draft treaty of the broadcasting organization . The fourth part is the limitation and exception of broadcasting organization right in the network environment . The principle of benefit balance is one of the basic principles of copyright law . When expanding the subject and scope of the broadcasting organization , we must pay attention to the balance of the interests of the public and the public . The fifth part is the legislative perfection of broadcasting organization right under the network environment of our country . Because of the stipulation of the right of broadcasting organization in accordance with the convention of Rome , some relevant provisions in the copyright law of our country have been unable to adapt to the current state of information technology development . On the basis of the above interpretation and analysis , the author discusses how to perfect the protection system of broadcasting organization right under the network environment from the four aspects of the subject , the content of the rights , the protection of rights and the right .
