【摘要】：民事訴訟保全按照保全對(duì)象的不同可以分為財(cái)產(chǎn)保全和行為保全。長(zhǎng)期以來(lái),我國(guó)訴訟法中并沒(méi)有關(guān)于行為保全的專門規(guī)定。本世紀(jì)初,為履行“入世”義務(wù),我國(guó)在知識(shí)產(chǎn)權(quán)法以及海事訴訟程序法中,分別對(duì)訴前責(zé)令停止侵犯知識(shí)產(chǎn)權(quán)及海事強(qiáng)制令進(jìn)行了規(guī)定。實(shí)際上,在其他類型民事訴訟案件中,同樣需要在訴訟中責(zé)令一方當(dāng)事人做出一定行為或者禁止其作出一定行為,以使當(dāng)事人免于受到損害或者使判決得以有效執(zhí)行。行為保全制度的長(zhǎng)期缺失,不能不說(shuō)是民事訴訟立法上的遺憾。2012年新修訂的民事訴訟法將原第九章“財(cái)產(chǎn)保全和先予執(zhí)行”更名為“保全和先予執(zhí)行”并對(duì)相關(guān)條款進(jìn)行了相應(yīng)的修訂,在學(xué)界討論多年的行為保全制度被引入民事訴訟程序中,而相關(guān)制度的構(gòu)建、完善需要在司法實(shí)踐中不斷地探索,筆者寫作的初衷就是對(duì)行為保全概念、特點(diǎn)等進(jìn)行理論探討,在比較國(guó)外行為保全立法及司法實(shí)踐的基礎(chǔ)上,對(duì)行為保全如何規(guī)范運(yùn)行提出建議,為該新制度的完善提供參考。
[Abstract]:According to the different objects of preservation, the preservation of civil action can be divided into property preservation and act preservation. For a long time, there are no special provisions on the preservation of acts in our procedural law. At the beginning of this century, in order to fulfill the obligation of "entering WTO", In the law of intellectual property rights and the law of maritime procedural procedure, the pre-litigation order to stop infringement of intellectual property rights and the maritime injunction are respectively stipulated in our country. In fact, in other types of civil litigation cases, It is also necessary to order or prohibit a party to do a certain act in an action in order to prevent the party from being harmed or to enable the effective enforcement of the judgment. In 2012, the newly revised Civil procedure Law renamed the original Chapter 9th "property preservation and first execution" as "preservation and first execution" and amended the relevant articles accordingly. The behavior preservation system, which has been discussed for many years in academic circles, has been introduced into the civil procedure, but the construction and perfection of the relevant system need to be constantly explored in the judicial practice. The author's original intention is to discuss the concept and characteristics of the act preservation. On the basis of comparing the legislation and judicial practice of act preservation in foreign countries, this paper puts forward some suggestions on how to regulate the operation of act preservation, and provides a reference for the perfection of the new system.
