【摘要】：2009年8月7-9日,教育部社會(huì)科學(xué)委員會(huì)法學(xué)學(xué)部2009年度工作會(huì)議暨中國(guó)特色社會(huì)主義法治建設(shè)的理論與實(shí)踐研討會(huì)在吉林市召開。在中國(guó)特色社會(huì)主義法治建設(shè)的理論與實(shí)踐研討會(huì)上,與會(huì)學(xué)者就中國(guó)特色社會(huì)主義法治道路、中國(guó)共產(chǎn)黨依法執(zhí)政與執(zhí)政體制創(chuàng)新、中國(guó)特色社會(huì)主義法律體系的建構(gòu)與發(fā)展、法律制度的中國(guó)特色與世界共性、中國(guó)知識(shí)產(chǎn)權(quán)法發(fā)展的基本經(jīng)驗(yàn)、中國(guó)特色證據(jù)法學(xué)體系的構(gòu)建、中國(guó)參與國(guó)際立法和司法等問題進(jìn)行了熱烈而深入的討論。雖然不同學(xué)者對(duì)中國(guó)特色社會(huì)主義法治發(fā)展道路和經(jīng)驗(yàn)的概括或分析有所不同,但與會(huì)學(xué)者普遍認(rèn)為,新中國(guó)成立60年來,特別是改革開放30年來,無論是就社會(huì)主義法治建設(shè)整體而言,還是就具體的法律領(lǐng)域而言,已經(jīng)形成了具有中國(guó)特色的發(fā)展道路和經(jīng)驗(yàn)。本刊這一期所載的十八篇文章是本次研討會(huì)的主要成果。這些成果對(duì)于我們進(jìn)一步思考中國(guó)特色社會(huì)主義法治建設(shè)的理論與實(shí)踐這一問題具有重要意義。
[Abstract]:7-9 August 2009. The 2009 Annual working Conference of the Department of Law of the Social Sciences Committee of the Ministry of Education and the Symposium on the Theory and practice of the Construction of the Socialist Rule of Law with Chinese characteristics was held in Jilin City. At the Symposium on the Theory and practice of the Construction of the Socialist Rule of Law with Chinese characteristics, The participating scholars discussed the road to the rule of law of socialism with Chinese characteristics, the innovation of the ruling and ruling system of the Communist Party of China according to law, the construction and development of the legal system of socialism with Chinese characteristics, the Chinese characteristics of the legal system and the commonness of the world. The basic experience of the development of China's intellectual property law, the construction of the legal system of evidence with Chinese characteristics, China's participation in international legislation and the administration of justice has been discussed in a heated and in-depth manner. Although different scholars have different generalizations and analyses of the road and experience of the development of socialism with Chinese characteristics, it is generally agreed that. In the 60 years since the founding of New China, especially in the 30 years since the reform and opening up, whether in terms of the construction of the socialist rule of law as a whole or in terms of specific legal fields, The 18 articles contained in this issue are the main results of this seminar. These results are helpful for us to further think about the construction of socialist rule of law with Chinese characteristics. The question of theory and practice is of great significance.
