【摘要】：促進(jìn)體育科技創(chuàng)新，推動(dòng)體育強(qiáng)國(guó)建設(shè)，是增強(qiáng)民族體質(zhì)，促進(jìn)體育事業(yè)發(fā)展的正確方向。專(zhuān)利文獻(xiàn)是科技發(fā)展水平和創(chuàng)新能力的核心體現(xiàn)，我們?cè)诖龠M(jìn)體育科技創(chuàng)新，推動(dòng)體育強(qiáng)國(guó)建設(shè)之際，必須高度重視體育發(fā)明專(zhuān)利對(duì)體育事業(yè)發(fā)展的重大作用，必須加快科技創(chuàng)新與專(zhuān)利的有機(jī)結(jié)合。本文通過(guò)對(duì)我國(guó)體育發(fā)明專(zhuān)利現(xiàn)狀調(diào)查與數(shù)據(jù)分析、體育發(fā)明專(zhuān)利轉(zhuǎn)化率現(xiàn)狀調(diào)查與影響因素分析，提出了促進(jìn)體育發(fā)明專(zhuān)利轉(zhuǎn)化的激勵(lì)政策。以期能夠促進(jìn)體育發(fā)明專(zhuān)利轉(zhuǎn)化，進(jìn)而促進(jìn)體育科技發(fā)展。 本文采用了多種研究方法，通過(guò)訪(fǎng)問(wèn)中國(guó)國(guó)家知識(shí)產(chǎn)權(quán)局、中國(guó)知識(shí)產(chǎn)權(quán)網(wǎng)、專(zhuān)利全文數(shù)據(jù)庫(kù)、科易網(wǎng)等網(wǎng)站，查閱、搜集了大量的數(shù)據(jù)并進(jìn)行了分類(lèi)的整理、分析。通過(guò)向一些從事專(zhuān)利研究的高校教授和專(zhuān)利代理機(jī)構(gòu)的資深專(zhuān)家訪(fǎng)談、以電話(huà)訪(fǎng)談的形式向國(guó)家知識(shí)產(chǎn)權(quán)局的相關(guān)負(fù)責(zé)人員進(jìn)行了詳細(xì)的請(qǐng)教，獲得了大量的相關(guān)數(shù)據(jù)和資料。 通過(guò)研究，在我國(guó)體育發(fā)明專(zhuān)利現(xiàn)狀方面得出了如下結(jié)論：第一我國(guó)體育發(fā)明專(zhuān)利的發(fā)展可以劃分為三個(gè)階段，我國(guó)體育發(fā)明專(zhuān)利授權(quán)增長(zhǎng)率基本與我國(guó)整體專(zhuān)利授權(quán)增長(zhǎng)率持平,體育專(zhuān)利授權(quán)總數(shù)正在持續(xù)快速增長(zhǎng)。第二我國(guó)體育發(fā)明專(zhuān)利分類(lèi)的現(xiàn)狀：專(zhuān)利種類(lèi)相對(duì)齊全，項(xiàng)目分布很不均衡。第三我國(guó)體育發(fā)明專(zhuān)利發(fā)明類(lèi)型的現(xiàn)狀是職務(wù)發(fā)明比例過(guò)小，體育院校、科研單位輸出較小。第四體育發(fā)明專(zhuān)利轉(zhuǎn)化率過(guò)低。根據(jù)我國(guó)體育發(fā)明專(zhuān)利現(xiàn)狀，分析了我國(guó)體育發(fā)明專(zhuān)利轉(zhuǎn)化的影響因素，制定了促進(jìn)我國(guó)體育發(fā)明專(zhuān)利轉(zhuǎn)化的激勵(lì)政策，最后提出了促進(jìn)體育發(fā)明專(zhuān)利轉(zhuǎn)化的“政用產(chǎn)學(xué)研”創(chuàng)新合作系統(tǒng)。倡導(dǎo)實(shí)現(xiàn)：以政府為主導(dǎo)，，建立促進(jìn)專(zhuān)利轉(zhuǎn)化法制、幫扶政策和專(zhuān)利轉(zhuǎn)化機(jī)制，通過(guò)政策支持、財(cái)政補(bǔ)貼、提供獎(jiǎng)勵(lì)、減免稅收、發(fā)放貸款等激勵(lì)措施改變專(zhuān)利“重保護(hù)輕轉(zhuǎn)化”的局面，激發(fā)發(fā)明人和企業(yè)專(zhuān)利轉(zhuǎn)化的熱情，引導(dǎo)體育發(fā)明專(zhuān)利高效轉(zhuǎn)化；以用戶(hù)為中心，進(jìn)行體育發(fā)明專(zhuān)利研發(fā)設(shè)計(jì)時(shí)，充分考慮用戶(hù)的需求和消費(fèi)情況等實(shí)際問(wèn)題，設(shè)計(jì)出真正幫助科學(xué)健身的人性化產(chǎn)品，滿(mǎn)足用戶(hù)需求；以探尋適合企業(yè)生產(chǎn)的市場(chǎng)經(jīng)濟(jì)模式為重點(diǎn)，采取政策幫扶，加強(qiáng)產(chǎn)學(xué)研的系統(tǒng)性和合作能力；以抓好教育科研工作為關(guān)鍵，加強(qiáng)對(duì)各高校特別是體育院校以及各體育科研機(jī)構(gòu)的科研要求，采取各種激勵(lì)政策，鼓勵(lì)職務(wù)發(fā)明，提高發(fā)明質(zhì)量，加強(qiáng)發(fā)明人實(shí)現(xiàn)專(zhuān)利轉(zhuǎn)化的內(nèi)在動(dòng)力。
[Abstract]:Promoting scientific and technological innovation in sports and building a powerful sports country is the correct direction for strengthening national physique and promoting the development of sports. Patent literature is the core embodiment of the level of scientific and technological development and the ability of innovation, and we are promoting scientific and technological innovation in sports. At the time of promoting the construction of sports powerful nation, we must attach great importance to the important function of sports invention patent to the development of sports cause, and speed up the organic combination of science and technology innovation and patent. Based on the investigation of the current situation of the patent conversion rate of sports inventions and the analysis of the influencing factors, this paper puts forward an incentive policy to promote the transformation of sports invention patents in order to promote the transformation of sports invention patents and further promote the development of sports science and technology. This paper adopts a variety of research methods, by visiting the Chinese State intellectual property Office, China intellectual property Network, Patent Full-text Database, Keyi Web, and other websites, we have collected a large number of data and sorted them out. Through interviews with university professors engaged in patent research and senior experts from patent agencies, detailed consultation was conducted with relevant responsible personnel of the State intellectual property Office in the form of telephone interviews. A large number of relevant data and materials have been obtained. Through research, the author draws the following conclusions in the current situation of sports invention patent in China: first, the development of sports invention patent in China can be divided into three stages. The growth rate of sports invention patent license in China is basically the same as that of the whole patent license in China, and the total number of sports patent license is increasing rapidly. Second, the current situation of the classification of sports invention patent in China is: the patent category is relatively complete, The distribution of items is very uneven. Third, the present situation of sports invention patent type in our country is that the proportion of post invention is too small, the output of sports institution and scientific research unit is small. 4th sports invention patent conversion rate is too low. According to the present situation of sports invention patent in our country, This paper analyzes on the factors influencing the patent transformation of sports inventions in China, and formulates the incentive policies to promote the patent transformation of sports inventions in China. Finally, the paper puts forward the innovation cooperation system of "administrative industry, university and research" to promote the patent transformation of sports inventions. It advocates the realization of: taking the government as the leader, establishing the legal system to promote the patent transformation, helping the policy and the mechanism of patent transformation, supporting through the policy, financial subsidy. To provide incentives, such as incentives, tax breaks and loans, to change the situation of patent protection and light transformation, to stimulate the enthusiasm of inventors and enterprises in patent transformation, to guide the efficient transformation of sports invention patents, and to take the user as the center. When researching and designing the sports invention patent, we should fully consider the actual problems such as the needs of the users and the consumption situation, and design the humanized products that really help the scientific fitness to meet the needs of the users. Focusing on exploring a market economy model suitable for enterprise production, we should adopt policies to help strengthen the systematization and cooperation ability of industry, education and research, and take the work of education and scientific research as the key point. To strengthen the scientific research requirements of colleges and universities, especially physical education colleges and sports scientific research institutions, to adopt various incentive policies, to encourage job inventions, to improve the quality of inventions, and to strengthen the intrinsic motive force for inventors to realize the transformation of patents.
