【摘要】：：知識產(chǎn)權(quán)證券化屬于資產(chǎn)證券化的范疇,是一種新興的融資方式,己經(jīng)為發(fā)達國家的文化產(chǎn)業(yè)和高科技產(chǎn)業(yè)的發(fā)展起到了巨大的推動作用。在進行知識產(chǎn)權(quán)證券化時,風(fēng)險隔離機制是知識產(chǎn)權(quán)證券化得以成功進行的保證,所以對知識產(chǎn)權(quán)證券化的應(yīng)用離不開對風(fēng)險隔離機制的深刻把握�；谝陨显�,本文對知識產(chǎn)權(quán)證券化中的風(fēng)險隔離機制進行了探討,主要研究了“被證券化知識產(chǎn)權(quán)選定"的法律問題、“真實銷售"的法律問題以及“破產(chǎn)隔離”法律問題,并分別對我國法律中涉及的相關(guān)問題進行檢討并給出相應(yīng)的建議。
[Abstract]:Intellectual property securitization belongs to the category of asset securitization, is a new financing method, has played a great role in promoting the development of cultural and high-tech industries in developed countries. The risk isolation mechanism is the guarantee that intellectual property securitization can be carried on successfully, so the application of intellectual property securitization can not be separated from the deep understanding of risk isolation mechanism. This paper discusses the mechanism of risk isolation in the securitization of intellectual property, mainly studies the legal problems of "selected intellectual property rights by securitization", the legal problems of "real sale" and the legal problems of "bankruptcy isolation". And the relevant issues involved in Chinese law are reviewed and the corresponding suggestions are given.
