【摘要】：《民法總則》第123條將知識(shí)產(chǎn)權(quán)定義為"專有的"權(quán)利,本意是彰顯知識(shí)產(chǎn)權(quán)的特征,尤其是區(qū)分物權(quán)與知識(shí)產(chǎn)權(quán)。該立法表述既源自"專有性是知識(shí)產(chǎn)權(quán)的特征"這一理論通說(shuō),也源自對(duì)知識(shí)財(cái)產(chǎn)保護(hù)中專有權(quán)模式與制止不正當(dāng)競(jìng)爭(zhēng)模式二者關(guān)系的忽視。"專有性是知識(shí)產(chǎn)權(quán)的特征"在邏輯上無(wú)法證立。出于法教義學(xué)的目的,此條的"專有的"限定只能被解釋為一種語(yǔ)言習(xí)慣,既不意味著在實(shí)質(zhì)上肯定了專有性是知識(shí)產(chǎn)權(quán)的特點(diǎn),也不意味著排除了制止不正當(dāng)競(jìng)爭(zhēng)保護(hù)。
[Abstract]:Article 123 of the Civil Code defines intellectual property rights as "proprietary" rights, intended to highlight the characteristics of intellectual property rights. In particular, the distinction between real right and intellectual property is derived from the general theory that "exclusivity is the characteristic of intellectual property". It also stems from the neglect of the relationship between the exclusive right mode and the mode of preventing unfair competition in the protection of intellectual property. "exclusivity is the characteristic of intellectual property" is logically impossible to establish. The "proprietary" qualification of this article can only be interpreted as a language custom and does not imply the substantive affirmation of exclusivity as a characteristic of intellectual property rights or the exclusion of protection against unfair competition.
