虛擬角色的知識(shí)產(chǎn)權(quán)保護(hù)研究

【摘要】:虛擬角色本身是創(chuàng)造性作品中為作者所塑造的具有鮮明個(gè)性特征的藝術(shù)形象。成功的虛擬角色能夠?qū)姰a(chǎn)生無(wú)限的吸引力與影響力。隨著文化產(chǎn)業(yè)與物質(zhì)產(chǎn)業(yè)的發(fā)展,虛擬角色往往被“二次”開發(fā)或利用于文學(xué)藝術(shù)創(chuàng)作領(lǐng)域與商業(yè)活動(dòng)領(lǐng)域,且日益脫離作品本身而具有獨(dú)立的經(jīng)濟(jì)價(jià)值。但是我國(guó)并未將虛擬角色明確作為知識(shí)產(chǎn)權(quán)法所保護(hù)的對(duì)象。然而,有關(guān)虛擬角色的權(quán)益糾紛卻不斷在我國(guó)司法實(shí)踐中涌現(xiàn)。虛擬角色的知識(shí)產(chǎn)權(quán)保護(hù)問(wèn)題不僅關(guān)乎虛擬角色創(chuàng)作者的切身利益,且關(guān)系到社會(huì)物質(zhì)活動(dòng)與文化活動(dòng)的繁榮。無(wú)疑,虛擬角色的知識(shí)產(chǎn)權(quán)保護(hù)問(wèn)題值得我們?nèi)パ芯颗c探討。為此,本文以實(shí)現(xiàn)我國(guó)虛擬角色的知識(shí)產(chǎn)權(quán)保護(hù)為最終落腳點(diǎn),從有關(guān)虛擬角色的基本法律問(wèn)題入手,在此基礎(chǔ)上分析了虛擬角色知識(shí)產(chǎn)權(quán)保護(hù)的法理基礎(chǔ)與必要性問(wèn)題,并通過(guò)剖析傳統(tǒng)知識(shí)產(chǎn)權(quán)法體系對(duì)虛擬角色知識(shí)產(chǎn)權(quán)保護(hù)的局限性,力圖尋求我國(guó)虛擬角色知識(shí)產(chǎn)權(quán)保護(hù)的正確路徑。本文除引言外,共分四章。 第一章虛擬角色的基本法律問(wèn)題。本章詳細(xì)闡述了“虛擬角色的界定”、“虛擬角色的組成要素”、“虛擬角色的種類”及“虛擬角色的利用方式”四個(gè)基本問(wèn)題。 第二章虛擬角色保護(hù)的法理基礎(chǔ)與必要性。在掌握有關(guān)虛擬角色的基本法律問(wèn)題的前提下,本章試圖對(duì)虛擬角色受知識(shí)產(chǎn)權(quán)保護(hù)的法理基礎(chǔ)與必要性問(wèn)題進(jìn)行了分析與論證。 第三章傳統(tǒng)知識(shí)產(chǎn)權(quán)模式對(duì)虛擬角色的保護(hù)及其局限。首先,本章介紹了世界主要國(guó)家與地區(qū)對(duì)虛擬角色予以知識(shí)產(chǎn)權(quán)保護(hù)的現(xiàn)狀。其次,本章在此基礎(chǔ)上,就傳統(tǒng)知識(shí)產(chǎn)權(quán)法體系對(duì)虛擬角色知識(shí)產(chǎn)權(quán)保護(hù)的局限性問(wèn)題進(jìn)行了剖析與總結(jié)。 第四章我國(guó)虛擬角色知識(shí)產(chǎn)權(quán)保護(hù)的路徑。本章分為四節(jié),主要從虛擬角色在文學(xué)藝術(shù)創(chuàng)作領(lǐng)域的利用與虛擬角色在商業(yè)活動(dòng)領(lǐng)域的利用兩個(gè)方面,分別探討了虛擬角色在不同利用方式下的保護(hù)路徑。概言之,筆者認(rèn)為,我國(guó)應(yīng)單獨(dú)依據(jù)版權(quán)法對(duì)虛擬角色存文學(xué)藝術(shù)創(chuàng)作領(lǐng)域的利用予以保護(hù);且需突破傳統(tǒng)知識(shí)產(chǎn)權(quán)法體系,確立虛擬角色商品化權(quán)對(duì)其在商業(yè)活動(dòng)領(lǐng)域的利用提供保護(hù)
[Abstract]:The virtual character itself is the artistic image with distinctive personality created by the author in the creative works. The successful virtual character can produce infinite attraction and influence to the public. With the development of the cultural and material industries, Virtual characters are often "secondary" developed or used in the field of literary and artistic creation and commercial activities, Moreover, it is increasingly independent of the work itself and has independent economic value. However, our country does not explicitly regard the virtual role as the object protected by intellectual property law. However, disputes about the rights and interests of virtual characters are constantly emerging in the judicial practice of our country. The protection of intellectual property rights of virtual characters is not only related to the vital interests of fictitious role creators, but also related to the prosperity of social material and cultural activities. The protection of intellectual property rights of virtual characters is worthy of our study and discussion. Therefore, this paper takes the protection of intellectual property rights of virtual roles in China as the ultimate goal, starting with the basic legal problems of virtual roles. On this basis, this paper analyzes the legal basis and necessity of the protection of virtual role intellectual property rights, and analyzes the limitations of the traditional intellectual property law system on the protection of virtual role intellectual property rights. This article is divided into four chapters except the introduction. The first chapter deals with the basic legal problems of virtual roles, including the definition of virtual roles, the constituent elements of virtual roles, the types of virtual roles and the ways of using virtual roles. The second chapter is the legal basis and necessity of virtual role protection. On the premise of mastering the basic legal problems of virtual role, this chapter attempts to analyze and prove the legal basis and necessity of virtual role protection under intellectual property rights. The third chapter introduces the protection and limitation of virtual role by traditional intellectual property model. Firstly, this chapter introduces the current situation of intellectual property protection of virtual role in major countries and regions of the world. This paper analyzes and summarizes the limitation of traditional intellectual property law system to the protection of virtual role intellectual property rights. This chapter is divided into four sections, mainly from the use of virtual roles in the field of literary and artistic creation and the use of virtual roles in the field of commercial activities. In general, the author thinks that China should protect the use of virtual characters in the field of literary and artistic creation solely according to copyright law. It is also necessary to break through the traditional intellectual property law system and establish the right of commercialization of virtual role to protect its utilization in the field of commercial activities.
