【摘要】：分享經(jīng)濟(jì)爆發(fā)式增長的同時,不同類型的分享經(jīng)濟(jì)對現(xiàn)行監(jiān)管體系帶來挑戰(zhàn),平臺企業(yè)法律定位模糊,交易主體權(quán)益損害,知識產(chǎn)權(quán)矛盾劇化,市場不正當(dāng)競爭,公共產(chǎn)品負(fù)外部性等拷問法律法規(guī)適用、行政監(jiān)督權(quán)力配置、監(jiān)督意識轉(zhuǎn)變和監(jiān)管手段創(chuàng)新。信用監(jiān)管成為解決分享經(jīng)濟(jì)監(jiān)管困境的有效措施之一。建立以信用為核心的分享經(jīng)濟(jì)分類監(jiān)管體系,形成企業(yè)自治、行業(yè)自律、社會監(jiān)督和政府監(jiān)管的市場共治格局,有利于緩解政府市場規(guī)制與鼓勵分享經(jīng)濟(jì)發(fā)展之間的沖突,打破監(jiān)管機(jī)構(gòu)間信息孤島,形成線上線下一體化的監(jiān)管體系。
[Abstract]:At the same time, different types of sharing economy have brought challenges to the current regulatory system, the legal positioning of platform enterprises is vague, the rights and interests of trading subjects are damaged, and intellectual property rights conflicts become dramatic. Market unfair competition, negative externalities of public goods and other torture laws and regulations applicable, administrative supervision power allocation. The transformation of supervision consciousness and innovation of supervision means. Credit supervision has become one of the effective measures to solve the dilemma of sharing economic supervision. The establishment of credit as the core of the sharing economic classification regulatory system, the formation of enterprise autonomy, industry self-discipline. The market co-governance pattern of social supervision and government supervision is conducive to alleviating the conflict between government market regulation and encouraging the development of sharing economy, breaking the isolated island of information among regulatory agencies, and forming an integrated supervision system between line and offline.
