【摘要】：食品安全可追溯體系被普遍認為是從根源上保障食品安全最可靠、最有效的途徑之一，特別是在目前我國食品安全形勢不容樂觀的情況下，構(gòu)建科學嚴密的食品安全可追溯體系，發(fā)揮刑法對其獨特的保護作用，有著重大的現(xiàn)實意義。本文通過對食品安全可追溯體系的新解，以及國內(nèi)外法律法規(guī)對該體系保護的梳理和比較，闡述了加強刑法對食品安全可追溯體系保護的重要意義，分析了我國刑法在保護該體系中存在的困難，提出了食品安全可追溯體系與刑法保護有效銜接的思路。 本文共分四個部分：第一部分為食品安全可追溯體系概述。對食品安全可追溯體系的基本概念進行了新的闡述，，分析了我國食品安全可追溯體系構(gòu)建及立法沿革情況。第二部分為我國食品安全可追溯體系刑法保護現(xiàn)狀。通過對我國食品安全可追溯體系刑法保護現(xiàn)狀的梳理，指出了我國刑法在保護食品安全可追溯體系上面臨的困境。第三部分為域外食品安全可追溯體系法制保護考察。主要對歐盟、日本和美國食品安全可追溯體系法制保護狀況進行了梳理，為我國食品安全可追溯體系的刑法保護提供借鑒。第四部分為加強我國食品安全可追溯體系刑法保護的基本構(gòu)想。指出了加強我國食品安全可追溯體系刑法保護的重要意義，并從納入刑法調(diào)整范疇、做好行政執(zhí)法與刑事司法銜接、完善公眾參與機制三個方面，提出了加強刑法對食品安全可追溯體系的剛性實施及其關(guān)鍵節(jié)點制度安排保護的思路和建議。
[Abstract]:The traceability system of food safety is generally considered to be one of the most reliable and effective ways to ensure food safety from the root causes, especially when the current food safety situation in China is not optimistic. It is of great practical significance to construct a scientific and strict traceability system of food safety and give full play to the unique protective role of criminal law. Through the new interpretation of the traceability system of food safety, as well as the combing and comparison of the protection of the system by laws and regulations at home and abroad, this paper expounds the significance of strengthening the protection of the traceability system of food safety in criminal law. This paper analyzes on the difficulties existing in the protection of the system in the criminal law of our country, and puts forward the idea of effectively connecting the traceability system of food safety with the protection of the criminal law. This paper is divided into four parts: the first part is an overview of food safety traceability system. This paper expounds the basic concept of food safety traceability system, and analyzes the construction and legislative evolution of food safety traceability system in China. The second part is the current situation of criminal law protection of food safety traceability system in China. By combing the present situation of criminal law protection of food safety traceability system in China, this paper points out the difficulties faced by Chinese criminal law in protecting food safety traceability system. The third part is the investigation of the legal protection of the traceability system of foreign food safety. This paper mainly combs the legal protection of the traceability system of food safety in EU, Japan and the United States, and provides a reference for the criminal law protection of the traceability system of food safety in China. The fourth part is the basic conception of strengthening the criminal law protection of food safety traceability system in our country. This paper points out the significance of strengthening the criminal law protection of the traceability system of food safety in our country, and from three aspects: bringing it into the category of criminal law adjustment, doing a good job in the connection between administrative law enforcement and criminal justice, and perfecting the mechanism of public participation. This paper puts forward some ideas and suggestions on strengthening the rigid implementation of the traceability system of food safety and the protection of the key node system in the criminal law.
