【摘要】：隨著網(wǎng)絡(luò)購物不斷流行發(fā)展,出現(xiàn)了以網(wǎng)購為平臺(tái)的"網(wǎng)絡(luò)碰瓷"投機(jī)取巧的違法行為,因其網(wǎng)絡(luò)自身的全球、開放、交互、虛擬、不確定性等特殊屬性,使得網(wǎng)絡(luò)行為極其隱蔽,行為人主體身份難確定,訛詐行為多樣化,證據(jù)難固定,其違法的管轄地難確定,對其治理有一定的難度,對我國的網(wǎng)絡(luò)行為法律規(guī)制、網(wǎng)絡(luò)監(jiān)管提出了新的挑戰(zhàn)。
[Abstract]:With the continuous development of online shopping, there has been opportunistic illegal behavior of "network touch porcelain" based on online shopping platform, because of its global, open, interactive, virtual, uncertain and other special attributes of the network itself. The network behavior is extremely hidden, the identity of the main body of the perpetrator is difficult to determine, the behavior of blackmail is diversified, the evidence is difficult to be fixed, the jurisdiction of the violation of the law is difficult to determine, it is difficult to govern it, and the legal regulation of the network behavior of our country. Network regulation presents new challenges.
