【摘要】：積極一般預(yù)防理論著力法律忠誠(chéng)意識(shí)的培養(yǎng),強(qiáng)調(diào)規(guī)范有效性的確證,申彰秩序信賴的穩(wěn)定預(yù)期,致力社會(huì)同一性的維系,力圖通過(guò)刑法規(guī)范的明文宣示和刑罰適用的懲罰教育,導(dǎo)引守法善行,貶抑違規(guī)惡徑,實(shí)現(xiàn)規(guī)范認(rèn)同。然而,積極一般預(yù)防以刑罰的強(qiáng)制懲戒作為教育公眾遵循刑法,學(xué)習(xí)守法善行的手段,又不可能徹底撇離威懾,陷入威懾與認(rèn)同的正當(dāng)性紛擾之中;積極一般預(yù)防以法忠誠(chéng)意識(shí)的訓(xùn)練為內(nèi)容,而未能觸及規(guī)范本身的善惡性質(zhì)甄別,陷入忠誠(chéng)惡法的正當(dāng)性危機(jī);積極一般預(yù)防凸顯刑罰懲戒對(duì)公眾規(guī)范意識(shí)的喚醒,抨擊威懾刑對(duì)人的工具利用,無(wú)從實(shí)質(zhì)改變積極一般預(yù)防將人作為預(yù)防公眾犯罪的工具性效用,陷入工具正當(dāng)性的困境之中。因此,刑法的知識(shí)轉(zhuǎn)型需要對(duì)積極一般預(yù)防理論保持應(yīng)有的警醒與反思。
[Abstract]:The positive general theory of prevention focuses on the cultivation of legal loyalty consciousness, emphasizing the confirmation of the validity of norms, the stable expectation of confidence in order, and the maintenance of social identity. Through the explicit declaration of the criminal law norms and the punishment education applicable to the penalty, the author tries to guide the law-abiding good deeds, detracts the illegal ways, and realizes the normative identity. However, the positive general prevention takes the compulsory punishment of punishment as a means to educate the public to follow the criminal law and learn to obey the law and do good deeds, and it is impossible to completely turn away from deterrence and fall into the legitimacy of deterrence and identity. Positive general prevention takes the training of legal loyalty consciousness as the content, but fails to touch the good and evil nature of the norm itself, and falls into the legitimacy crisis of loyalty and evil law. Positive general prevention highlights the awakening of punishment and punishment to public awareness of norms, criticizes the use of human tools by deterrent punishment, and does not change the utility of active general prevention as a tool to prevent public crime. Caught in the dilemma of tool legitimacy. Therefore, the knowledge transformation of criminal law needs to maintain due vigilance and reflection on positive general prevention theory.
