【摘要】：新型支付方式帶來了財(cái)產(chǎn)流動(dòng)的多樣化途徑。支付方式的多元化和財(cái)產(chǎn)轉(zhuǎn)移的快捷性增加了流通渠道和提升了流轉(zhuǎn)效率,與此同時(shí)財(cái)產(chǎn)犯罪手段也變得更加隱蔽和復(fù)雜。在新型支付環(huán)境中,流轉(zhuǎn)環(huán)節(jié)的間接化導(dǎo)致財(cái)產(chǎn)性質(zhì)也因支付載體之不同而呈現(xiàn)不同特征,因此單從行為的個(gè)別外部特征討論新型支付方式下財(cái)產(chǎn)犯罪的定罪問題必然導(dǎo)致罪名認(rèn)定的偏頗,應(yīng)以財(cái)產(chǎn)流轉(zhuǎn)為線索,依托于財(cái)產(chǎn)性質(zhì)之認(rèn)定而揭示犯罪行為所指向法益,進(jìn)而厘清新型支付方式下不同財(cái)產(chǎn)犯罪行為間罪名之分歧。
[Abstract]:The new way of payment brings a variety of ways to the flow of property. The diversification of payment methods and the quickness of property transfer increase the circulation channel and improve the circulation efficiency, meanwhile, the means of property crime become more subtle and complex. In the new payment environment, the indirect flow leads to the different characteristics of the property because of the different payment carriers. Therefore, it is necessary to discuss the conviction of property crime under the new payment mode only from the individual external characteristics of the behavior, which will inevitably lead to the bias of the conviction of the crime, and should take the property circulation as the clue and reveal the legal benefits that the criminal act points to, depending on the nature of the property. And then clarify the differences between different property crimes under the new payment method.
