【摘要】：伴隨網(wǎng)絡(luò)世界的發(fā)展和革新，網(wǎng)絡(luò)空間中違法犯罪現(xiàn)象呈現(xiàn)出越演越烈之勢，其中網(wǎng)絡(luò)中介服務(wù)提供者的幫助行為加功于被幫助人實行行為危害法益情況更為嚴重。該行為不僅嚴重危及網(wǎng)絡(luò)空間的和諧發(fā)展，也對傳統(tǒng)的刑法理論和司法實踐帶來了巨大的沖擊。本文通過對網(wǎng)絡(luò)服務(wù)提供者分類明確可能成為承擔刑事責任的網(wǎng)絡(luò)服務(wù)主體；并分析了對傳統(tǒng)刑法領(lǐng)域關(guān)于幫助犯理論的具體分析和網(wǎng)絡(luò)中介服務(wù)提供者幫助行為的實質(zhì)分析，闡明了網(wǎng)絡(luò)空間中介服務(wù)提供者幫助行為在異化的傳統(tǒng)刑法理論下處罰的不利和其幫助行為的危害性和可罰性，以求通過片面共犯正犯化的理論和實踐分析，尋找出一條解決網(wǎng)絡(luò)中介服務(wù)提供者幫助行為侵害法益的路徑，，適當擴張刑事法網(wǎng)，營造一個清朗的網(wǎng)絡(luò)空間。
[Abstract]:With the development and innovation of the network world, the phenomenon of illegal crime in cyberspace is becoming more and more violent, among which the help behavior of the network intermediary service provider is more serious than that of the aided person. This behavior not only seriously endangers the harmonious development of cyberspace, but also brings great impact to the traditional criminal law theory and judicial practice. By classifying network service providers, this paper makes it clear that they may become the subject of network services with criminal responsibility. It also analyzes the concrete analysis of the theory of aiding crime in the field of traditional criminal law and the essential analysis of the helping behavior of network intermediary service provider. This paper expounds the disadvantage of punishment and the harmfulness and punishment of the helping behavior of the intermediary service provider in cyberspace under the traditional criminal law theory of alienation, in order to analyze the theory and practice of one-sided accomplice through the theory and practice. To find a way to solve the problem of network intermediary service providers helping to violate the legal interests, to expand the criminal law network appropriately, and to create a clear network space.
