【摘要】：正賄賂犯罪是所謂"對合犯罪",這就決定了行賄人與受賄人的供述往往是定案的主要依據(jù),由此形成賄賂犯罪證據(jù)體系及審查機(jī)制的主觀性較強(qiáng)的特征,難以充分實(shí)現(xiàn)客觀公正。為此,應(yīng)建立客觀化的修補(bǔ)機(jī)制,以保障辦案質(zhì)量。對人證印證事實(shí)應(yīng)當(dāng)進(jìn)行客觀驗(yàn)證,包括:其一,對客體物事實(shí)進(jìn)行驗(yàn)證;其二,以權(quán)錢交易的客觀可能性
[Abstract]:The crime of bribery is the so-called "adversarial crime", which determines that the confession of the bribe-giver and the bribe-taker is often the main basis of the final decision, thus forming the subjective characteristics of the evidence system and the examination mechanism of the bribery crime.
