【摘要】：駕駛汽車故意撞擊他人車輛,倒車時因?qū)Ψ剿緳C搶奪方向盤致使汽車行駛方向產(chǎn)生偏差,將圍觀的群眾撞死,駕駛?cè)撕蛽寠Z方向盤人的行為符合多個罪名的客觀要件,在刑法上如何定罪量刑存在較大爭議。本文從刑法上因果關(guān)系的原理為出發(fā)點,具體分析行為人的客觀行為是否構(gòu)成危害結(jié)果的主導原因力,以期對實踐辦案有所裨益。
[Abstract]:When driving a car deliberately hits another person's vehicle, when reversing, the other driver snatches the steering wheel and causes the direction of the car to deviate, thus killing the onlookers, and the behavior of the driver and the steering-wheel person conforms to the objective requirements of many charges. How to convict and sentence in criminal law is controversial. Starting from the principle of causality in criminal law, this paper concretely analyzes whether the objective behavior of the perpetrator constitutes the leading force of the harmful result, in order to benefit the practice of handling the case.
