【摘要】：犯罪輕重實際上具有實踐形態(tài)、價值形態(tài)和規(guī)范形態(tài)三種存在狀態(tài),三種形態(tài)之間未必一致與吻合。與三種形態(tài)對應(yīng)的是判定犯罪輕重的三種標(biāo)準(zhǔn):實踐標(biāo)準(zhǔn)、理論標(biāo)準(zhǔn)和規(guī)范標(biāo)準(zhǔn),其中實踐標(biāo)準(zhǔn)是判定犯罪輕重的首要準(zhǔn)則,對理論標(biāo)準(zhǔn)和規(guī)范標(biāo)準(zhǔn)具有指引與評價作用。探索實踐標(biāo)準(zhǔn)可以通過圍繞犯罪輕重影響因子設(shè)置各種不同變量實驗方案來實現(xiàn),而最終確定實驗結(jié)果的科學(xué)與否,則要其經(jīng)歷社會公眾認(rèn)同、學(xué)者修正和國家司法實踐檢驗的過程。
[Abstract]:In fact, the degree of crime has three existing states: practice form, value form and normative form, and the three forms may not be consistent with each other. What corresponds to the three forms is the three standards of judging the seriousness of crime: practice standard, theory standard and standard, among which the practice standard is the primary criterion for judging the seriousness of crime, which has the function of guidance and evaluation to the theoretical standard and standard. To explore practical standards can be achieved by setting up various variable experimental schemes around the factors affecting the severity of crime, and ultimately determining whether the results of the experiment are scientific or not, it is necessary for them to experience social and public approval. The process of scholars' revision and the examination of national judicial practice.
