【摘要】：《刑法》第287條之二所規(guī)定的幫助信息網(wǎng)絡(luò)犯罪活動罪,并不是將幫助犯正犯化,只是幫助犯的量刑規(guī)則。因此,在其適用上,必須注意以下3點:一是成立本罪,必須在被幫助的他人即正犯著手實施犯罪之后,但對此處的"犯罪"必須做實質(zhì)性理解;二是必須明知他人利用信息網(wǎng)絡(luò)實施犯罪;三是刑法總則中有關(guān)共犯的處罰規(guī)定對本罪仍然適用。
[Abstract]:Article 287 bis of the Criminal Law stipulates that the crime of helping information network criminal activities is not a principal offender, but a sentencing rule of the assistant. Therefore, in its application, we must pay attention to the following three points: first, when this crime is established, it must be carried out by the other person who is assisted, that is, the principal offender, but the "crime" here must be substantive. Understanding; Second, we must be aware that others use the information network to commit a crime; Third, the general provisions of the Criminal Law on the punishment of accomplices is still applicable to this crime.
