【摘要】：故意"誤拆"以"誤拆"之名行強拆之實,事實上可能構(gòu)成故意毀壞財物罪。在故意"誤拆"的情形下,無論權(quán)力大小,權(quán)力尋租的背后,必然存在濫用職權(quán)、玩忽職守等職務犯罪行為。故意"誤拆"中職務犯罪存在的主要原因在于政府個別領(lǐng)導片面追求政績、具體的拆遷實施單位不當?shù)刈非蠼?jīng)濟利益、監(jiān)督機制不力以及官商相互勾結(jié)導致腐敗,致使職務犯罪滋生。徹底避免故意"誤拆",應該科學合理配置權(quán)力,改變干部考核機制,讓基層官員有升遷的正常途徑;同時加強媒體輿論監(jiān)督,發(fā)動輿論監(jiān)督的人民戰(zhàn)爭,讓故意"誤拆"沒有辦法遁形;建立官員財產(chǎn)申報制度,從根本上避免拆遷權(quán)力尋租,強拆而非"誤拆"貪官的保護墻。
[Abstract]:Intentional "false demolition" in the name of "false demolition" in the name of forced demolition, in fact may constitute the crime of vandalism. In the case of intentional "false disassembly", no matter how large or small the power is, there must be crimes of abuse of power, neglect of duty and so on behind the power rent-seeking. The main reasons for the existence of duty crime in intentional "false demolition" lie in the one-sided pursuit of political achievements by individual government leaders, the improper pursuit of economic interests by specific demolition and implementation units, the lack of supervision mechanism and the collusion between government and businessmen, which lead to corruption. Cause duty crime to breed. In order to avoid deliberately "disassembling by mistake," we should scientifically and reasonably allocate our power, change the cadre assessment mechanism, and allow grassroots officials to have a normal way of promotion; at the same time, we should strengthen media supervision by public opinion and launch a people's war over public opinion supervision. There is no way to hide the intentional "false demolitions"; to establish an official property declaration system, to fundamentally avoid rent-seeking of the power to demolish and remove, rather than "demolish" by mistake the protective wall of corrupt officials.
