【摘要】：新型支付方式主要是以手機(jī)銀行支付與第三方支付為代表的網(wǎng)絡(luò)移動(dòng)支付。新型支付方式下網(wǎng)絡(luò)侵財(cái)犯罪與傳統(tǒng)侵財(cái)犯罪的刑法規(guī)制和懲罰的思路并無二致。司法實(shí)踐中主要有盜竊罪、詐騙罪、信用卡詐騙罪三種觀點(diǎn)。新型支付方式的實(shí)質(zhì)是新型信用卡支付方式。新型支付方式賬戶內(nèi)的數(shù)字化財(cái)物可以直接作為侵財(cái)犯罪的對(duì)象。新型支付平臺(tái)其本質(zhì)是"機(jī)器人",可以成為詐騙類犯罪的對(duì)象,新型支付方式下網(wǎng)絡(luò)侵財(cái)犯罪的重要特征不是"賬戶資金被盜"而是"機(jī)器人"被騙。對(duì)于新型支付方式下盜騙交織型侵財(cái)犯罪案件的定性應(yīng)以信用卡詐騙罪定性。"竊取他人信用卡信息資料并通過互聯(lián)網(wǎng)、通訊終端使用"是對(duì)"盜竊信用卡并使用"的最新注解,立法上適時(shí)作出調(diào)整已十分必要。
[Abstract]:The new payment method is mainly mobile payment represented by mobile bank payment and third-party payment. Under the new payment mode, the idea of the criminal law regulation and punishment of the network invasion crime is the same as that of the traditional one. There are three main viewpoints in judicial practice: larceny, fraud and credit card fraud. The essence of the new payment method is the new credit card payment method. The digital property in the new payment method can be directly regarded as the object of the crime of invading money. The nature of the new payment platform is "robot", which can be the object of fraud crime. The important characteristic of the network invasion crime under the new payment mode is not "account funds stolen" but "robot" being cheated. The crime of credit card fraud should be used as the characterization of the crime of embezzlement and intertwined invasion of money under the new payment mode. " Stealing other people's credit card information and using it through Internet and communication terminal is the latest annotation of "stealing credit card and using it". It is necessary to make timely adjustment in legislation.
