高速公路沖卡逃費(fèi)行為之刑法定性研究

【摘要】:隨著經(jīng)濟(jì)的快速發(fā)展,高速公路也有著快速的發(fā)展。目前,我國(guó)約有8.5萬(wàn)公里總里程的高速公路,位居世界第二。高速公路發(fā)展的同時(shí)也伴隨著諸多新問(wèn)題,逃費(fèi)問(wèn)題尤為嚴(yán)重。對(duì)此,目前我國(guó)對(duì)高速公路逃費(fèi)行為無(wú)成文刑法加以約束,對(duì)逃費(fèi)行為多要求補(bǔ)繳通行費(fèi),情節(jié)嚴(yán)重的予以罰款、行政拘留。面對(duì)巨大的經(jīng)濟(jì)利益,逃費(fèi)行為人的逃費(fèi)成本為幾乎為零。 本文由引言、正文與余論三部分組成。首先,筆者介紹了高速公路沖卡逃費(fèi)現(xiàn)狀及司法實(shí)踐中對(duì)于此種行為的處理情況。其次,歸納介紹了逃費(fèi)行為的概念、方式,并進(jìn)而分析了沖卡逃費(fèi)行為的概念、特征與表現(xiàn)形式。再次,歸納出實(shí)踐中對(duì)此種行為的定性爭(zhēng)議,即有罪說(shuō)與無(wú)罪說(shuō),并先就無(wú)罪說(shuō)進(jìn)行分析,進(jìn)而提出此種觀點(diǎn)是不足取的,接下來(lái)介紹了有罪說(shuō)內(nèi)部的觀點(diǎn)爭(zhēng)議,并給出自己的評(píng)析;最后,從高速公路通行費(fèi)的性質(zhì)問(wèn)題與沖卡逃費(fèi)行為的行為結(jié)構(gòu)入手,得出筆者的定性觀點(diǎn),即此行為構(gòu)成搶奪罪。至此,,本文告一段落,筆者在余論部分還提出了一些有待深入探討的問(wèn)題,如在遇到具體犯罪的定性難題時(shí),如何在刑法立法論與刑法解釋論間進(jìn)行取舍,對(duì)這些問(wèn)題筆者期待著日后能進(jìn)行進(jìn)一步研究。
[Abstract]:With the rapid development of economy, the highway also has the fast development. At present, China has about 85000 kilometers of total mileage highway, ranked second in the world. Highway development is accompanied by many new problems, especially the problem of escape fee. In view of this, at present, our country has no written criminal law to restrict the behavior of freeway evading fees, and the behavior of evading fees often requires to pay additional tolls, if the circumstances are serious, fines should be imposed, and administrative detention is required. In the face of huge economic benefits, the cost of evading fees is almost zero. This paper consists of three parts: introduction, text and conclusion. First of all, the author introduces the current situation of freeway punching and escaping fee and how to deal with this kind of behavior in judicial practice. Secondly, this paper introduces the concept and mode of fee evasion behavior, and then analyzes the concept, characteristics and manifestation of charge evasion behavior. Thirdly, summarize the qualitative controversy of this kind of behavior in practice, that is, the theory of guilt and innocence, and analyze the theory of innocence first, and then put forward this view is insignificant, and then introduce the internal controversy of the theory of guilt. Finally, starting with the nature of highway tolls and the behavior structure of toll evasion, the author draws the author's qualitative point of view that this behavior constitutes the crime of robbery. At this point, this paper comes to a close, the author also puts forward some questions that need to be discussed deeply, such as how to choose and choose between the theory of criminal law legislation and the theory of explanation of criminal law when confronted with the qualitative problem of specific crime. The author looks forward to further study on these problems in the future.
