【摘要】："非法占有"是對他人財(cái)產(chǎn)權(quán)利的全面侵害。在財(cái)產(chǎn)犯罪中,"非法占有目的 "具有排除加利用意思,是區(qū)別于犯罪故意的主觀性超過要素,與故意、客觀違法要素共同構(gòu)成取得型財(cái)產(chǎn)犯罪。非法占有目的的意思表示具有區(qū)分罪與非罪、此罪與彼罪以及影響刑罰的機(jī)能,其產(chǎn)生時(shí)間不僅成為民刑規(guī)制非法占有的分界,也關(guān)系到非法吸收公眾存款罪和集資詐騙罪的認(rèn)定。非法占有目的不要說只是從客觀方面區(qū)分相關(guān)罪名以至區(qū)分目的難以實(shí)現(xiàn)。
[Abstract]:Illegal possession is a comprehensive infringement of the property rights of others. In the crime of property, "the purpose of illegal possession" has the intention of exclusion and utilization, which is different from the subjective factor of criminal intent, and constitutes the crime of obtaining property together with the elements of intention and objective violation. The meaning of the purpose of illegal possession has the distinction between crime and non-crime, this crime and that crime, as well as the function of influencing the penalty, its producing time is not only the dividing line of the civil penalty regulation of illegal possession. Also related to the illegal absorption of public deposits and the crime of financing fraud. The purpose of illegal possession is not only difficult to achieve, but also to distinguish the related crimes from the objective aspects.
