【摘要】：使用信用卡在個人移動POS機上完成轉賬的表現(xiàn)之一是信用卡內資金轉移至與POS機綁定的儲蓄卡中。在現(xiàn)實中,由信用卡持卡人向其本人儲蓄卡轉賬的情形確實是一種常見的信用卡套現(xiàn)類型。如果個人移動POS機綁定的儲蓄卡并非歸信用卡持有人所有,則信用卡中的資金一旦轉出,信用卡持有人便對該部分資金失去控制。是否具有實施轉賬的意圖是決定將對資金的控制是否轉移的核心要素,產生轉賬意圖也可謂相當于產生了將對資金的控制轉移給他人的意圖。如果行為人以非法占有為目的,通過虛構事實、隱瞞真相使得他人產生在個人移動POS機上實施轉賬的意圖,能夠符合詐騙罪的構成要件。
[Abstract]:One of the performances of using credit cards to transfer funds from personal mobile POS machines is to transfer funds from the credit card to a savings card bound to the POS machine. In reality, the transfer of credit card holders to their own savings cards is indeed a common type of credit card cash. If a savings card tied to a personal mobile POS machine is not owned by the credit card holder, the credit card holder loses control of that portion of the money once the funds are transferred out of the credit card. Whether the intention of carrying out the transfer is the core element to decide whether to transfer the control over the funds, the intention of the transfer is equivalent to the intention of transferring the control of the funds to others. If the perpetrator takes the illegal possession as the purpose, conceals the truth through the fictitious fact, causes the other person to produce the intention to carry on the transfer in the personal mobile POS machine, can accord with the constitutive elements of the crime of fraud.
