【摘要】：近年來，危險駕駛行為頻發(fā)并且造成了惡劣的社會影響。在風(fēng)險社會下,為了對危險駕駛行為進行有效地調(diào)控，《刑法修正案八》將危險駕駛罪作為新增罪名在刑法中予以規(guī)定。危險駕駛行為的入罪，表明國家保護公民的合法權(quán)利和維護社會公共秩序的決心。本文立足于當(dāng)前的現(xiàn)實，對風(fēng)險刑法觀念下的危險駕駛罪進行分析和闡述。 本文正文共分為四部分。在第一章中，首先介紹了風(fēng)險刑法的基本理論。風(fēng)險刑法是風(fēng)險社會的產(chǎn)物，它所保護的法益是抽象的；適用的范圍具有擴張性，更多體現(xiàn)的是行為無價值理論；風(fēng)險刑法關(guān)注的重點是危險犯，目的是為了降低社會風(fēng)險，增強主體的安全感。但在近期內(nèi)，傳統(tǒng)刑法理論仍是刑法的主導(dǎo)理論，風(fēng)險刑法只是傳統(tǒng)刑法理論的有益補充，不會取代傳統(tǒng)刑法理論成為刑法的主導(dǎo)理論。緊接著，筆者對風(fēng)險刑法理論在國內(nèi)外的應(yīng)用價值進行了考察，發(fā)現(xiàn)風(fēng)險刑法早在二十世紀(jì)五六十年代就在國外環(huán)境、產(chǎn)品責(zé)任和交通安全領(lǐng)域得到了廣泛應(yīng)用，而我國《刑法修正案八》的通過，是風(fēng)險刑法觀念在我國刑法產(chǎn)品責(zé)任領(lǐng)域與交通安全領(lǐng)域適用的體現(xiàn)。 從第二章起，，本文開始對我國的危險駕駛罪進行解析。我國規(guī)定的危險駕駛罪有兩種類型：“飆車”型危險駕駛罪和“醉駕”型危險駕駛罪。文章首先對這兩種類型的危險駕駛罪的客觀行為進行細致的分析，然后對危險駕駛罪主觀方面的爭議進行理性思考，得出危險駕駛罪的主觀方面是故意的結(jié)論，最后對本罪的出罪機制予以探討，論證了“醉駕”型危險駕駛罪是不可以適用刑法第13條但書的規(guī)定的。 通過上文對風(fēng)險刑法理論和危險駕駛罪的介紹，文章第三部分就可以對兩者的關(guān)系進行分析。在此之前，首先要對危險駕駛罪的性質(zhì)予以明確。在對危險犯及其相關(guān)的具體危險犯與抽象危險犯劃分之后，筆者得出“飆車”型危險駕駛罪是具體危險犯，“醉駕”型危險駕駛罪是抽象危險犯，并在第二節(jié)中對危險駕駛罪符合風(fēng)險刑法觀從立法與司法上進行了詳述。 在論證了危險駕駛罪符合風(fēng)險刑法觀念的基礎(chǔ)之上，筆者主張應(yīng)用風(fēng)險刑法的相關(guān)理論對危險駕駛罪中的缺陷進行規(guī)制。在注意危險犯的擴張與風(fēng)險刑法的有限適用之下，筆者傾向于對危險駕駛罪從三個方面進行規(guī)制：一、設(shè)制開放性款，擴大風(fēng)險刑法理念的應(yīng)用范圍；二、明確“飆車型”危險駕駛罪“情節(jié)惡劣”的情形，限制風(fēng)險刑法的適用；三、規(guī)定“醉駕”的臨檢程序，從實際操作中規(guī)范法律的適用。
[Abstract]:In recent years, dangerous driving has been frequent and has caused a bad social impact. In the risk society, in order to control the dangerous driving behavior effectively, the criminal law amendment eight > defines the crime of dangerous driving as a new crime in the criminal law. The crime of dangerous driving indicates that the state protects the legal rights of citizens and the maintenance of the society. This article, based on the current reality, analyzes and expounds the crime of dangerous driving under the concept of risk criminal law.
The text of this article is divided into four parts. In the first chapter, the basic theory of the risk criminal law is first introduced. The risk criminal law is the product of the risk society. The legal benefit it protects is abstract; the scope of the application is expansionary, and more embodies the theory of the value of the behavior. The focus of the risk criminal law is the dangerous crime, the purpose is to reduce the risk. Social risk enhances the sense of security of the subject. But in the near future, the traditional criminal theory is still the dominant theory of the criminal law, and the risk criminal law is only a beneficial supplement to the traditional criminal law theory, and it will not replace the traditional criminal theory as the dominant theory of the criminal law. The criminal law was widely used in the field of foreign environment, product liability and traffic safety as early as 50s and 60s twentieth Century, and the adoption of the eight amendment of criminal law in China was the embodiment of the application of the concept of risk criminal law in the field of product liability and traffic safety in China's criminal law.
From the second chapter, this article begins to analyze the crime of dangerous driving in our country. There are two types of dangerous driving crime in our country: "drag racing" type dangerous driving crime and "drunk driving" type dangerous driving crime. The article first analyzes the objective behavior of the two types of dangerous driving crime, and then to the subjective side of dangerous driving crime. The subjective aspect of the crime of dangerous driving is a deliberate conclusion. Finally, the crime mechanism of the crime is discussed. It is demonstrated that the "drunk driving" type of dangerous driving is not applicable to the thirteenth proviso of the criminal law.
Through the introduction of the theory of risk criminal law and the crime of dangerous driving, the third part of the article can analyze the relationship between the two. Before this, the nature of the crime of dangerous driving should be clarified first. After the division of dangerous offenders and related specific dangerous offenders and abstract dangerous criminals, the author draws the crime of "drag racing" type dangerous driving. It is a specific dangerous crime, the "drunk driving" type of dangerous driving crime is an abstract dangerous crime, and in the second section of the dangerous driving crime conforms to the risk of the criminal law view from the legislation and judicature.
On the basis of demonstrating that the dangerous driving crime conforms to the concept of the risk criminal law, the author advocates the application of the relevant theory of the risk criminal law to regulate the defects in the crime of dangerous driving. Under the limited application of the expansion of dangerous criminals and the limited application of the risk criminal law, the author tends to regulate the crime of dangerous driving from three aspects: first, the establishment and opening up of the criminal law To expand the scope of the application of the concept of the risk of criminal law; two, to define the "bad circumstances" of the "drag racing" dangerous driving crime, to limit the application of the risk criminal law; three, to stipulate the procedure of the "drunk driving", and to standardize the application of the law from the actual operation.
