【摘要】：近年來,隨著海上石油運(yùn)輸?shù)脑黾?全球海洋環(huán)境的污染也隨之越來越嚴(yán)重。其中船舶污染是造成海洋污染的主要原因之一,各國法律在規(guī)定了相關(guān)民事賠償責(zé)任的基礎(chǔ)上,開始執(zhí)行和重視船舶污染事故的刑事化處理,這符合環(huán)境法發(fā)展的大趨勢。我國要在全面了解國際以及其他國家相關(guān)立法的基礎(chǔ)上,探索符合中國國情的船舶污染防治道路。 本文共分為六個部分。 第一部分,對船舶污染刑事責(zé)任追究的現(xiàn)狀。在該部分中,首先對全球油污事故的現(xiàn)狀做出了描述,總結(jié)了船舶污染事故刑事立法發(fā)展的趨勢,并介紹了國際、國內(nèi)相關(guān)船舶污染的刑事立法情況和追究機(jī)制現(xiàn)狀。 第二部分,船舶污染犯罪的主體。重點(diǎn)講述了船長,船員等相關(guān)自然人可以成為本罪的犯罪主體,單位也可以作為本罪的犯罪主體。 第三部分,船舶污染事故中可能涉及的刑事罪名。在船舶污染案件中,可能涉及交通肇事罪、污染環(huán)境罪、重大責(zé)任事故罪等罪名。 第四部分,刑事立案標(biāo)準(zhǔn)。根據(jù)目前我國的刑法及相關(guān)司法解釋,分析船舶污染事件的刑事立案標(biāo)準(zhǔn)。 第五部分,行政執(zhí)法機(jī)關(guān)對涉嫌船舶污染犯罪案件的移送問題。指出在船舶污染案件中,執(zhí)法機(jī)關(guān)與相關(guān)司法機(jī)關(guān)的銜接問題。 第六部分,船舶污染刑事責(zé)任制度的完善。本部分從立法層面和執(zhí)法層面上對追究船舶污染刑事責(zé)任的相關(guān)制度和體系提出了意見和建議。
[Abstract]:In recent years, with the increase of oil transportation, the pollution of the global marine environment is becoming more and more serious. Among them, ship pollution is one of the main causes of marine pollution. On the basis of the relevant civil liability, the laws of various countries begin to implement and attach importance to the criminal treatment of marine pollution accidents, which is in line with the general trend of the development of environmental law. On the basis of comprehensive understanding of the relevant legislation of international and other countries, our country should explore the road of ship pollution prevention and control in accordance with China's national conditions. This paper is divided into six parts. The first part is the current situation of investigating the criminal liability for ship pollution. In this part, firstly, the current situation of oil pollution accidents in the world is described, the development trend of criminal legislation of ship pollution accidents is summarized, and the international situation is introduced. The present situation of criminal legislation and investigation mechanism of ship pollution in China. The second part, the subject of ship pollution crime. The main point is that the master, crew and other related natural persons can be the subject of the crime, and the unit can also be the subject of the crime. Part three, the criminal charges that may be involved in the ship pollution accident. In the case of ship pollution, it may involve the crime of causing traffic accident, the crime of polluting the environment, the crime of serious liability accident and so on. According to the criminal law and related judicial interpretation of our country at present, this paper analyzes the criminal record standard of ship pollution incident. Part five, the transfer of the suspected ship pollution crime case by the administrative law enforcement agency. The paper points out the connection between the law enforcement agencies and the relevant judicial organs in ship pollution cases. The sixth part is the perfection of the criminal liability system for ship pollution. This part puts forward some opinions and suggestions on the system and system of investigating the criminal responsibility of ship pollution from the legislative level and law enforcement level.
