【摘要】：21世紀(jì)以來(lái),伴隨著互聯(lián)網(wǎng)通信技術(shù)的迅猛發(fā)展,社會(huì)生活水平也得以不斷提升。然而,互聯(lián)網(wǎng)及通信技術(shù)的不斷升級(jí),使得犯罪形式呈現(xiàn)出多樣化,各類詐騙案件開始以高科技手段對(duì)社會(huì)穩(wěn)定造成危害。殊不知是由于相關(guān)治理政策的滯后性,才造成對(duì)這些社會(huì)問(wèn)題的應(yīng)對(duì)出現(xiàn)了治理真空。在該背景之下,當(dāng)前我國(guó)新型電信網(wǎng)絡(luò)詐騙犯罪頻發(fā)高發(fā),給人民群眾造成巨大的經(jīng)濟(jì)損失和無(wú)法估量的精神傷害,造成了嚴(yán)重的不良社會(huì)后果。基于此,本文梳理與吸收國(guó)內(nèi)外學(xué)者對(duì)電信網(wǎng)絡(luò)詐騙的研究成果,宏觀上查閱相關(guān)統(tǒng)計(jì)數(shù)據(jù)精準(zhǔn)分析目前我國(guó)電信網(wǎng)絡(luò)詐騙的現(xiàn)狀及危害,微觀上系統(tǒng)全面梳理分析國(guó)內(nèi)近年來(lái)著名的徐玉玉被騙案件,研究其背后我國(guó)電信網(wǎng)絡(luò)詐騙數(shù)量保持高位運(yùn)行態(tài)勢(shì)的根本原因,進(jìn)而提出相應(yīng)的治理策略。本研究的最終目的是為推動(dòng)我國(guó)電信網(wǎng)絡(luò)詐騙由無(wú)序、無(wú)效治理走向有序、有效治理提供良好的理論探索與智力支持。本研究?jī)?nèi)容主要包括六部分:第一部分解釋為何開展對(duì)電信網(wǎng)絡(luò)詐騙研究及這一研究的價(jià)值,并且梳理了國(guó)內(nèi)外相關(guān)學(xué)者對(duì)電信網(wǎng)絡(luò)詐騙的研究成果;第二部分對(duì)電信網(wǎng)絡(luò)詐騙的相關(guān)概念及理論進(jìn)行系統(tǒng)全面的闡釋;第三部分主要通過(guò)查閱相關(guān)統(tǒng)計(jì)數(shù)據(jù)精準(zhǔn)把握當(dāng)前我國(guó)電信網(wǎng)絡(luò)詐騙的宏觀現(xiàn)狀,微觀上對(duì)徐玉玉被騙案件進(jìn)行全面系統(tǒng)梳理,進(jìn)而概括總結(jié)電信網(wǎng)絡(luò)詐騙的危害;第四部分對(duì)當(dāng)前我國(guó)電信網(wǎng)絡(luò)詐騙高發(fā)頻發(fā)背后的原因進(jìn)行全面分析;第五部分提出全面的治理策略;第六部分,全面系統(tǒng)總結(jié)當(dāng)前我國(guó)電信網(wǎng)絡(luò)詐騙治理對(duì)策,并指出研究中的不足與展望。本文主要以公共治理理論為理論依據(jù),結(jié)合經(jīng)濟(jì)學(xué)角度的成本收益理論剖析電信網(wǎng)絡(luò)詐騙頻發(fā)高發(fā)的原因,并提出了公安、銀行、電信、民眾等主體共同構(gòu)建治理體制機(jī)制的可行性,為我國(guó)切實(shí)推進(jìn)電信網(wǎng)絡(luò)詐騙問(wèn)題的治理提出優(yōu)化措施,具備一定的理論研究?jī)r(jià)值和實(shí)踐參考價(jià)值。
[Abstract]:Since the 21 st century, with the rapid development of Internet communication technology, the standard of social life has been continuously improved. However, with the continuous upgrading of Internet and communication technology, the forms of crime are diversified, and all kinds of fraud cases begin to endanger social stability by high-tech means. However, because of the lag of the relevant governance policies, there is a governance vacuum to deal with these social problems. Under this background, the crime of the new type of telecommunication network fraud occurs frequently in our country, which causes huge economic loss and incalculable mental injury to the people, resulting in serious adverse social consequences. Based on this, this paper combs and absorbs the research achievements of domestic and foreign scholars on telecom network fraud, and macroscopically looks up relevant statistical data to accurately analyze the current situation and harm of telecom network fraud in our country. This paper systematically analyzes the famous fraud cases of Xu Yuyu in China in recent years, studies the fundamental reasons behind the fraud of telecom network in our country, and puts forward the corresponding management strategies. The ultimate purpose of this study is to provide a good theoretical exploration and intellectual support for the promotion of telecom network fraud from disorder, ineffective governance to order and effective governance in China. The main contents of this study include six parts: the first part explains why the research on telecom network fraud and the value of this study, and combing the domestic and foreign scholars on telecommunications network fraud research results; The second part of the telecommunications network fraud related concepts and theories of a systematic and comprehensive explanation; the third part mainly through consulting the relevant statistical data accurately grasp the current situation of telecom network fraud macro situation. Microscopically, the author systematically combs Xu Yuyu's fraud case, and then summarizes the harm of telecom network fraud. The fourth part makes a comprehensive analysis of the reasons behind the high frequency of telecom network fraud in our country. The fifth part puts forward the comprehensive governance strategy, the sixth part, summarizes the current telecom network fraud governance countermeasures, and points out the shortcomings and prospects of the research. This article mainly takes the public governance theory as the theoretical basis, unifies the economical angle cost benefit theory to analyze the telecommunication network fraud frequency high occurrence reason, and proposed the public security, the bank, the telecommunication, The feasibility of the public and other subjects to construct the governance system mechanism together, and to put forward the optimization measures for our country to promote the management of the telecom network fraud problem, which has certain theoretical research value and practical reference value.
