【摘要】：我國于2004年開始實(shí)行農(nóng)機(jī)購置補(bǔ)貼政策，，該政策的實(shí)施為推動(dòng)我國農(nóng)業(yè)機(jī)械化進(jìn)程起到了重要作用。農(nóng)機(jī)購置補(bǔ)貼政策實(shí)施的10年間，取得了顯著的成果，使得我國農(nóng)業(yè)機(jī)械化程度有了明顯的提高，惠及全國主要農(nóng)業(yè)省份和地區(qū),但同時(shí)也暴露出了現(xiàn)行政策、管理模式中所存在的大量問題，其中以政策實(shí)施后該領(lǐng)域農(nóng)機(jī)管理部門的職務(wù)犯罪問題尤為突出。為使強(qiáng)農(nóng)惠農(nóng)政策進(jìn)一步穩(wěn)步實(shí)行，使農(nóng)民真正得到補(bǔ)貼、大力推動(dòng)新農(nóng)村建設(shè)、促進(jìn)農(nóng)業(yè)發(fā)展根本目的得以落實(shí)，深入研究農(nóng)機(jī)購置補(bǔ)貼領(lǐng)域的職務(wù)犯罪的政策背景、現(xiàn)狀、特點(diǎn)、誘發(fā)原因，對制定該領(lǐng)域的職務(wù)犯罪預(yù)防措施具有重要的參考價(jià)值。 本文從對我國現(xiàn)行的農(nóng)機(jī)購置補(bǔ)貼政策的基本現(xiàn)狀出發(fā)，深入分析該政策實(shí)施背景、實(shí)施現(xiàn)狀、操作流程以及與農(nóng)機(jī)購置補(bǔ)貼領(lǐng)域職務(wù)犯罪相關(guān)的法律，總結(jié)其中的存在的問題與漏洞。根據(jù)對農(nóng)機(jī)購置補(bǔ)貼領(lǐng)域職務(wù)犯罪的現(xiàn)狀和呈現(xiàn)態(tài)勢的分析，本文明確了農(nóng)機(jī)購置補(bǔ)貼領(lǐng)域職務(wù)犯罪的基本含義，歸納與農(nóng)機(jī)購置補(bǔ)貼相關(guān)的職務(wù)犯罪所呈現(xiàn)出的主要特點(diǎn)，從權(quán)力的使用不當(dāng)、政策制度的完善程度、監(jiān)管力度不到位以及利益驅(qū)動(dòng)等方面進(jìn)行分析，總結(jié)內(nèi)部和外部兩個(gè)方面導(dǎo)致該領(lǐng)域職務(wù)犯罪高發(fā)的原因。本文從完善政策制定、加大審核力度、改善市場環(huán)境、加強(qiáng)法制宣傳四個(gè)方面對提出預(yù)防該領(lǐng)域職務(wù)犯罪的建議，以期能夠?qū)υ擃I(lǐng)域職務(wù)犯罪預(yù)防有一定的實(shí)踐價(jià)值。
[Abstract]:In 2004, China began to implement the policy of purchasing subsidies for agricultural machinery, which played an important role in promoting the process of agricultural mechanization in China. During the 10 years of implementation of the agricultural machinery purchase subsidy policy, remarkable results have been achieved, which has made the degree of agricultural mechanization in our country obviously improved, benefiting the major agricultural provinces and regions of the country, but at the same time, it has also exposed the existing policies. There are a lot of problems in the management mode, especially the problem of duty crime in the agricultural machinery management department after the implementation of the policy. In order to further carry out the policy of strengthening agriculture and benefiting agriculture steadily, to make farmers get real subsidies, to vigorously promote the construction of new countryside, to promote the implementation of the fundamental purpose of agricultural development, and to study in depth the policy background and present situation of job-related crimes in the field of agricultural machinery purchase subsidies, The characteristics and the induced reasons have important reference value for formulating the preventive measures of duty crime in this field. Starting from the basic situation of the current agricultural machinery purchase subsidy policy in China, this paper deeply analyzes the background, status quo, operation process and laws related to the duty crime in the field of agricultural machinery purchase subsidy. Summarize the existing problems and loopholes. Based on the analysis of the present situation and the present situation of the duty crime in the field of agricultural machinery purchase subsidy, this paper clarifies the basic meaning of the duty crime in the field of agricultural machinery purchase subsidy, and summarizes the main characteristics of the duty crime related to the purchase subsidy of agricultural machinery. This paper analyzes the improper use of power, the perfection of policy and system, the lack of supervision and interest drive, and summarizes the causes of the high incidence of job-related crimes in this field in both internal and external aspects. From four aspects of perfecting policy making, strengthening auditing, improving market environment and strengthening legal publicity, this paper puts forward some suggestions on the prevention of job-related crimes in this field, so as to have some practical value for the prevention of job-related crimes in this field.
