【摘要】：在科技日新月異的今天,數(shù)字技術(shù)的易拷貝性使得知識傳播變得輕而易舉,同時也對版權(quán)人的利益構(gòu)成重大挑戰(zhàn)。數(shù)字技術(shù)下,版權(quán)人權(quán)利的非主宰性、蔓延迅速性,以及侵權(quán)行為的智能化、隱蔽性強、偵查難度大等特點越發(fā)顯現(xiàn)。針對版權(quán)人在數(shù)字技術(shù)下可能蒙受的經(jīng)濟損失,需要從刑法角度做出及時且合理的制度安排,使其在保障版權(quán)人權(quán)利的同時又可兼顧文明的累積與知識的普及。
[Abstract]:With the rapid development of science and technology, the easy copy of digital technology makes it easy to spread knowledge, but also poses a great challenge to the interests of copyright owners. Under the digital technology, the rights of copyright owners have the characteristics of non-dominance, rapid spread, intelligent infringement, strong concealment and difficulty in investigation. In view of the possible economic losses suffered by copyright owners under digital technology, it is necessary to make timely and reasonable institutional arrangements from the angle of criminal law so that they can protect the rights of copyright owners and at the same time give consideration to the accumulation of civilization and the popularization of knowledge.
