【摘要】：給網(wǎng)絡服務提供者設定管理義務是各國立法的趨勢。國內(nèi)外立法規(guī)定的義務內(nèi)容基本相同,主要是協(xié)助執(zhí)法、內(nèi)容信息監(jiān)管、用戶數(shù)據(jù)保護,我國相關立法在管理義務的類型化、區(qū)別化方面與外國立法差距較大。我國網(wǎng)絡服務提供者除可能構(gòu)成作為犯形式的幫助犯外,還可能單獨構(gòu)成幫助他人利用信息網(wǎng)絡犯罪活動罪和拒不履行信息網(wǎng)絡安全管理義務罪。外國網(wǎng)絡服務提供者違反管理義務的法律責任主要是民事責任和行政責任。我國刑法設立拒不履行信息網(wǎng)絡安全管理義務罪存在過度犯罪化之缺陷。
[Abstract]:It is the trend of legislation to set up management obligations for network service providers. The content of obligations provided by domestic and foreign legislation is basically the same, mainly to assist in law enforcement, content information supervision, user data protection, the relevant legislation in our country in the type of management obligations, distinguish between the big gap with foreign legislation. The network service provider in our country not only may constitute the aiding crime as the form of crime, but also may constitute the crime of helping others to use the information network criminal activity and refusing to fulfill the duty of information network security management. The legal liability of foreign network service provider for breach of management obligation is mainly civil liability and administrative liability. The crime of refusing to fulfill the obligation of information network security management exists the defect of excessive crime in criminal law of our country.
