【摘要】：交通肇事罪的認(rèn)定,一直在理論和實務(wù)間存在不少爭點,同時也是難點,交通事故責(zé)任認(rèn)定作為行政行為,與交通肇事罪之間的關(guān)系,也一直存在爭議。根據(jù)最高院的司法解釋《關(guān)于審理交通肇事刑事案件具體應(yīng)用法律若干問題的解釋》中,在刑事犯罪四要素的基礎(chǔ)上,將交通事故的責(zé)任判定作為交通肇事罪成立與否的要素之一,這一規(guī)定在理論和實務(wù)中都引起了巨大爭議。本文針對交通肇事責(zé)任認(rèn)定和交通肇事罪定罪二者之間的關(guān)系進(jìn)行分析,基于交通事故責(zé)任認(rèn)定的性質(zhì),對二者之間的關(guān)系進(jìn)行探討,為理論研究提供思路,為審判實務(wù)提供借鑒,以期交通肇事案件的合理處理。
[Abstract]:The identification of traffic accident crime has been a lot of controversy between theory and practice, but also a difficult point. As an administrative act, the relationship between traffic accident crime and traffic accident responsibility has always been controversial. According to the judicial interpretation of the Supreme Court of Justice and the interpretation of some problems concerning the specific application of law in handling criminal cases of traffic accidents, on the basis of the four elements of criminal offenses, Taking the responsibility of traffic accident as one of the elements of traffic accident crime, this regulation has caused great controversy in theory and practice. This paper analyzes the relationship between traffic accident responsibility determination and traffic accident crime conviction. Based on the nature of traffic accident responsibility determination, this paper probes into the relationship between the two, and provides ideas for theoretical research. To provide reference for trial practice, with a view to reasonable handling of traffic accident cases.
