【摘要】："人肉搜索"作為現(xiàn)代網(wǎng)絡(luò)技術(shù)與傳統(tǒng)人工調(diào)查相結(jié)合的信息搜索方式,具有虛擬性、匿名性、盲從性、后果的多重性等特點。"人肉搜索"如果被惡意使用或者濫用,就會嚴(yán)重侵害他人的合法權(quán)益,包括對公民的隱私權(quán)、人格權(quán)、名譽權(quán)等權(quán)利造成侵害,具有嚴(yán)重的社會危害性。我國應(yīng)當(dāng)從刑法司法和刑法立法兩個層面對惡意的"人肉搜索"進(jìn)行規(guī)制,前者是指在現(xiàn)行刑法規(guī)定的框架內(nèi),在保持刑法穩(wěn)定的前提下,通過對《刑法》條文的妥當(dāng)解釋和正確適用,追究某些惡意"人肉搜索"行為人的刑事責(zé)任;后者是指在立法條件成熟的情況下,在《刑法》中增設(shè)"泄露他人隱私罪"或類似罪名,將惡意的"人肉搜索"單獨納入刑法進(jìn)行立法規(guī)制。
[Abstract]:"Human flesh search", as a combination of modern network technology and traditional artificial investigation, has the characteristics of fictitious, anonymous, blind and multiple consequences. " Human flesh search "if maliciously used or abused, it will seriously infringe upon the legitimate rights and interests of others, including the right to privacy, personality, reputation and other rights of citizens, with serious social harm." Our country should regulate the malicious "human flesh search" from two aspects of criminal law judicature and criminal law legislation. The former refers to maintaining the stability of criminal law within the framework of current criminal law. Through the proper interpretation and correct application of the articles of the Criminal Law, some malicious "human flesh search" perpetrators are investigated for their criminal responsibility; the latter refers to the situation in which the legislative conditions are ripe, The crime of "divulging the privacy of others" or the like is added to the Criminal Law, and the malicious "human flesh search" is separately incorporated into the criminal law for legislative regulation.
