【摘要】：正刑法總則將自首分為一般自首、準自首,刑法分則中還規(guī)定了適用于特定犯罪的特別自首,但由于法律規(guī)定的不明確,司法機關(guān)對這三類自首認識上存在混亂,如有的一旦否定了特別自首的認定,就不再考慮成立其他類型自首的可能性,而有的則僅考慮一般自首、準自首情節(jié)而忽略對特別自首的認定。對三種自首尤其是特別自首的把握不準確直接導(dǎo)致法律適用的錯誤,勢必會影響司法公信力。一、準確把握刑法對特別自首
[Abstract]:The general principles of the positive Criminal Law divide voluntary surrender into general surrender, quasi-surrender, and special voluntary surrender applicable to specific crimes. However, due to unclear legal provisions, there is confusion in the understanding of these three types of voluntary surrender by the judicial organs. If some deny the identification of special voluntary surrender, they will not consider the possibility of establishing other types of voluntary surrender, while others will only consider general surrender, quasi-surrender circumstances and ignore the recognition of special voluntary surrender. The inaccurate grasp of the three kinds of voluntary surrender, especially the special surrender, will directly lead to the mistakes in the application of the law, which will inevitably affect the judicial credibility.
