【摘要】：被害人承諾問(wèn)題的背后牽涉到的是國(guó)家刑罰權(quán)力運(yùn)作與公民個(gè)人權(quán)利自治之間的矛盾關(guān)系,因而成為現(xiàn)代刑事法治中的一個(gè)復(fù)雜而深刻的問(wèn)題。近年來(lái),隨著個(gè)人自由、權(quán)利意識(shí)的增強(qiáng),研究被害人承諾問(wèn)題就更加富有時(shí)代意義。本文關(guān)于被害人承諾若干問(wèn)題的探討,將著眼于對(duì)其基礎(chǔ)問(wèn)題與疑難問(wèn)題的研究;在研究過(guò)程中秉持理論與實(shí)踐相結(jié)合的原則,重在理論和立法的分析與闡釋。在具體內(nèi)容上主要分為五個(gè)方面:第一部分主要介紹國(guó)內(nèi)被害人承諾的立法現(xiàn)狀,我國(guó)并沒(méi)有將被害人承諾明確立法化,而是作為超法規(guī)的違法阻卻事由。第二部分對(duì)我國(guó)司法實(shí)踐中存在的問(wèn)題加以明確,以安樂(lè)死、非法行醫(yī)和幫助自殺等問(wèn)題為視角,闡述被害人承諾在我國(guó)立法化的緊迫性。司法實(shí)踐須以法律規(guī)定為依據(jù),立法的完善對(duì)實(shí)踐問(wèn)題的解決起到推動(dòng)作用。第三部分是對(duì)我國(guó)學(xué)界理論的介紹,我國(guó)關(guān)于被害人承諾理論雖然沒(méi)有大陸法系國(guó)家先進(jìn),但也形成了一些代表性的觀點(diǎn),指出利益衡量說(shuō)能夠?qū)Ρ缓θ顺兄Z問(wèn)題作出最合理的解釋,為刑事立法和司法實(shí)踐提供有力的理論支撐。第四部分是對(duì)英美法系和大陸法系的被害人承諾法律制度介紹以及評(píng)析,希望從中找到我國(guó)被害人承諾的立法模式。第五部分為本文的落腳點(diǎn),對(duì)被害人承諾重新進(jìn)行范圍界定,找準(zhǔn)被害人承諾的體系定位,為被害人承諾立法化奠定基礎(chǔ),提出被害人承諾問(wèn)題的刑事立法化構(gòu)想。
[Abstract]:The problem of victim commitment involves the contradictory relationship between the operation of state penalty power and the autonomy of individual rights of citizens, so it has become a complicated and profound problem in the modern criminal law. In recent years, with the enhancement of individual freedom and right consciousness, the study of victim commitment is of great significance. In this paper, we will focus on the study of the basic and difficult problems of the victim's commitment, and emphasize the analysis and interpretation of the theory and legislation in the course of the research on the principle of the combination of theory and practice. In the specific content mainly divided into five aspects: the first part mainly introduces the domestic victim commitment legislation situation our country does not explicitly legislate the victim commitment but as the illegal reason of the super regulation. The second part clarifies the problems existing in the judicial practice of our country, from the perspective of euthanasia, illegal practice of medicine and helping suicide, expounds the urgency of the victim's commitment to legislate in our country. The judicial practice must be based on the legal provisions, and the perfection of legislation can promote the solution of practical problems. The third part is an introduction to the academic theory of our country. Although the theory of victim commitment is not as advanced as that in civil law countries, it also forms some representative views. The author points out that the theory of interest measurement can give the most reasonable explanation to the problem of victim's commitment and provide a strong theoretical support for criminal legislation and judicial practice. The fourth part is the introduction and analysis of the legal system of victim commitment in Anglo-American law system and civil law system, hoping to find the legislative model of victim commitment in our country. The fifth part is the foothold of this article, which defines the scope of the victim commitment, finds the system orientation of the victim commitment, lays the foundation for the victim commitment legislation, and puts forward the criminal legislation conception of the victim commitment.
