【摘要】：跨境網(wǎng)絡(luò)犯罪1伴隨互聯(lián)網(wǎng)的發(fā)展而生并在全球范圍內(nèi)快速滋生和蔓延。此類(lèi)犯罪具有整體數(shù)量不斷攀升、組織化程度高、犯罪手段隱蔽復(fù)雜化、跨越多地區(qū)和多法域等特點(diǎn)。以上特性使得對(duì)跨境網(wǎng)絡(luò)犯罪的治理面臨刑事管轄權(quán)的沖突、執(zhí)法辦案中的調(diào)查取證難題、缺乏合作打擊跨境網(wǎng)絡(luò)犯罪的機(jī)制等諸多亟待解決的問(wèn)題。由此,在立法層面,應(yīng)確立刑事管轄權(quán)協(xié)調(diào)機(jī)制、彌補(bǔ)法律缺位和縮小法制落差;司法層面,應(yīng)加強(qiáng)訴訟證據(jù)支持、強(qiáng)化司法互助協(xié)議;執(zhí)法層面,應(yīng)優(yōu)化跨境警務(wù)合作模式、加強(qiáng)執(zhí)法技術(shù)培訓(xùn);社會(huì)層面,應(yīng)并進(jìn)進(jìn)行一般預(yù)防與特殊預(yù)防。
[Abstract]:With the development of the Internet, cross-border cybercrime is growing and spreading rapidly worldwide. This kind of crime has the characteristics of increasing number, high degree of organization, covert and complicated means of crime and crossing many regions and jurisdictions. The above characteristics make the governance of cross-border cybercrime face the conflict of criminal jurisdiction, the difficult problem of investigating and collecting evidence in the law enforcement, the lack of mechanism of cooperation to combat cross-border cybercrime, and many other problems need to be solved urgently. Therefore, at the legislative level, we should establish the coordination mechanism of criminal jurisdiction, make up for the absence of law and narrow the gap in legal system; at the judicial level, we should strengthen the support of procedural evidence and strengthen mutual legal assistance agreements; at the level of law enforcement, we should optimize the mode of cross-border police cooperation. Strengthen law enforcement technical training; social level, should be combined with general prevention and special prevention.
