【摘要】：網(wǎng)絡(luò)漫無國界,謠言亦無止境,多媒體時代背景下借助互聯(lián)網(wǎng)傳播謠言的態(tài)勢愈演愈烈,其造成的危害范圍廣、程度深且不良影響難以根除。網(wǎng)絡(luò)謠言雖已納入我國刑法規(guī)制范疇,關(guān)于網(wǎng)絡(luò)謠言相關(guān)的立法也日趨完備,但是進(jìn)步之余同時存在許多不足之處亟需改良,完善治理網(wǎng)絡(luò)謠言的相關(guān)立法和司法,合理把握對網(wǎng)絡(luò)謠言的打擊力度勢在必行。本文旨在簡要梳理我國當(dāng)下對網(wǎng)絡(luò)謠言刑法規(guī)制的幾點突出不足,并在此基礎(chǔ)上嘗試提出法治視野下我國對網(wǎng)絡(luò)謠言刑法規(guī)制的立法及司法完善建議,以期我國網(wǎng)絡(luò)謠言的刑法規(guī)制更加完善。
[Abstract]:Internet has no national boundaries and rumors are endless. Under the background of multimedia era, the spread of rumors with the help of the Internet is becoming more and more intense, which causes a wide range of harm, deep degree and difficult to eradicate the adverse effects.Although the network rumor has been brought into the scope of our criminal law regulation and the relevant legislation on the network rumor is becoming more and more complete, there are many deficiencies in the process of improvement, and the relevant legislation and judicature for the management of the network rumor should be improved at the same time.It is imperative to reasonably grasp the crackdown on network rumors.The purpose of this paper is to briefly sort out some outstanding deficiencies in the criminal regulation of network rumors in our country, and on this basis try to put forward the legislative and judicial suggestions for the criminal regulation of network rumors from the perspective of the rule of law in our country.Hope our country network rumor criminal law regulation is more perfect.
