本文選題：承繼幫助犯　切入點(diǎn)：事中幫助犯　出處：《中國刑事法雜志》2008年02期

【摘要】：將承繼幫助犯與事中幫助犯二個概念硬性加以區(qū)分,既無可能亦無必要;肯定論所據(jù)以立論的前提并不合適,對承繼幫助犯問題應(yīng)從否定的立場加以考量,即具體考察后行者加入犯罪后之時點(diǎn)下所粘合的特定狀態(tài),并根據(jù)該狀態(tài)所指向的法益侵害,來綜合判定后行者之責(zé)任。
[Abstract]:It is neither possible nor necessary to make a rigid distinction between the two concepts of inherited aiding crime and assistive offender in the matter; the premise on which the affirmation theory is based is not appropriate, and the problem of inherited helper crime should be considered from a negative standpoint.That is to specifically investigate the specific state that the post-walker joined in the time after the crime and judge the responsibility of the post-walker synthetically according to the legal interest infringement which the state points to.
