【摘要】：網(wǎng)絡(luò)漏洞檢測是新興的網(wǎng)絡(luò)行為,因動(dòng)機(jī)、對(duì)象、授權(quán)、工具、技術(shù)、影響等多方面的不同而在類型上呈現(xiàn)出復(fù)雜多樣性。對(duì)有關(guān)行為的刑法規(guī)制,我國目前主要是圍繞《刑法》第二百八十五條來進(jìn)行體系建構(gòu)的。就該中心法條而言,規(guī)范性關(guān)鍵詞的含義值得商榷,前置法規(guī)定的設(shè)計(jì)存有欠缺,情節(jié)性規(guī)定過于籠統(tǒng),客體要件還顯得粗疏,這些不足之處共同制約著該法條乃至整個(gè)法文本體系規(guī)制作用的有效發(fā)揮,應(yīng)當(dāng)予以完善。同時(shí),在具體適用過程中,要切實(shí)注重主觀方面要件的審查機(jī)能,并強(qiáng)化對(duì)有關(guān)行為之刑罰必要性、合理性的追問,充分貫徹、落實(shí)體系化規(guī)制的思維理念。
[Abstract]:Network vulnerability detection is a new kind of network behavior. Because of different motivation, object, authorization, tools, technology, influence and so on, network vulnerability detection presents complex diversity in types.At present, our country mainly constructs the system around Article 285 of Criminal Law.As far as the central law is concerned, the meaning of normative keywords is debatable, the design of the former law is deficient, the plot provisions are too general, and the object elements are also rough.These deficiencies restrict the regulation function of the law and the whole text system, and should be perfected.At the same time, in the concrete application process, we should pay attention to the examination function of the subjective elements, and strengthen the necessity and rationality of the punishment of the relevant acts, and fully carry out and carry out the thinking idea of systematized regulation.
